RESOLUTION NO. 25-89
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING FINAL PARCEL MAP 2023-112, LOCATED AT 229 AVENIDA MONTEREY WHEREAS, the property owner and subdivider, Monterey 229 LLC, a California limited liability company, owns a recently constructed two-unit apartment building located at 229 Avenida Monterey; and WHEREAS, the subdivider applied for a Tentative Parcel Map in order to subdivide the two-unit apartment building into two condominiums; and WHEREAS, the Tentative Parcel Map 2023-112 was approved by the Zoning Administrator on September 21, 2023 through Resolution ZA 23-015; and WHEREAS, the Tentative Parcel Map 2023-112 was amended to remove two Conditions of Approval and approved by the City Planner on February 24, 2025; and WHEREAS, Resolution ZA 23-015 included Conditions of Approval for the subdivider to obtain California Coastal Commission approval for the proposed Final Parcel Map, City Attorney approval of Conditions, Covenants and Restrictions (CC&Rs), and obtain from all persons having any interest in existing rights of way for pipelines for the conveyance of water and the rights to all underground water; and WHEREAS, the subdivider has satisfied all the Conditions of Approval and offered to the City water rights as dedicated; and WHEREAS, this project was previously found Categorically Exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and 15301.k (Class 1: Existing Facilities) in connection with the approval of the Tentative Parcel Map; and WHEREAS, pursuant to the provisions of the Subdivision Map Act and the City Municipal Code Chapter 16, Final Parcel Maps require City Council action for approval, denial, or modifications; and WHEREAS, on June 17, 2025, the City Council considered a resolution approving Final Parcel Map 2023-112 at its regular meeting.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the San Clemente City Council hereby approves Final Parcel Map 2023-112 as it conforms to the requirements set forth in the Subdivision Map Act and the previously approved Tentative Parcel Map.
SECTION 3. That the San Clemente City Council hereby accepts on behalf of the City of San Clemente the water rights as dedicated in Final Parcel Map 2023-112.
SECTION 4. That the Public Works Director/City Engineer is authorized and directed to execute the Final Parcel Map.
SECTION 5. That the City Clerk is authorized and directed to execute and submit the Final Parcel Map for recordation with the County of Orange Recorder’s Office.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
