RESOLUTION NO. 25-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING FINAL PARCEL MAP 2018-137, A 3 LOT SUBDIVISION LOCATED AT 143 NORTH LA ESPERANZA WHEREAS, the property owner and subdivider, Edward M. Sanchez, owns a 21,536 square foot single-family residential lot located at 143 North La Esperanza; and WHEREAS, on August 21, 2018, the San Clemente City Council adopted Resolution No. 18-19 approving Tentative Parcel Map 2018-137 for 143 North La Esperanza, which approval was considered null and void after 24 months given that no final parcel map was recorded; and WHEREAS, on September 19, 2024, an application was submitted by Richard Frei, 914 East Katella Avenue, Anaheim, CA 92805, on behalf of property owner Edward Sanchez, and deemed complete by staff on January 10, 2025, for Tentative Parcel Map 2018- 137 (PHP24-346), a request to subdivide one single-family residential lot into three lots. The project site is 143 North La Esperanza, adjacent to Interstate-5 at the north end of North La Esperanza, and within the Residential Lot-Density Zone (RL). The site’s legal description is Portion of Lots 10-13, Tract 898, and Assessor’s Parcel Number 057-095- 01; and WHEREAS, on February 5, 2025, Planning Commission adopted Resolution PC25-002, recommending that the City Council approve the project with the required findings and Conditions of Approval and determining that the project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions); and WHEREAS, on April 1, 2025, the City Council of the City of San Clemente held a duly noticed public hearing on the subject application, considered written and oral comments, and facts and evidence presented by the applicant, City staff, and any other interested parties; and WHEREAS, on April 1, 2025, the City Council adopted Resolution 25-34, approving Tentative Parcel Map 2018-137 with the required findings and Conditions of Approval and determining that the project is categorically exempt from the requirements of CEQA pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions); and WHEREAS, Resolution 25-34 included Conditions of Approval for the subdivider to dedicate any interest in existing rights of way for pipelines for the conveyance of water and the rights to all underground water; and WHEREAS, the subdivider has satisfied all the Conditions of Approval and offered to the City water rights as dedicated; and WHEREAS, this project was previously found Categorically Exempt from the requirements of the California Environmental Quality Act pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) in connection with the approval of the Tentative Parcel Map; and WHEREAS, pursuant to the provisions of the Subdivision Map Act and the City Municipal Code Chapter 16, Final Parcel Maps require City Council action for approval, denial, or modifications; and WHEREAS, on June 17, 2025, the City Council considered a resolution approving Final Parcel Map 2018-137.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the San Clemente City Council hereby approves Final Parcel Map 2018-137 as it conforms to the requirements set forth in the Subdivision Map Act and the previously approved Tentative Parcel Map.
SECTION 3. That the San Clemente City Council hereby accepts on behalf of the City of San Clemente the water rights as dedicated.
SECTION 4. That the Public Works Director/City Engineer is authorized and directed to execute the Final Parcel Map.
SECTION 5. That the City Clerk is authorized and directed to execute and submit the Final Parcel Map for recordation with the County of Orange Recorder’s Office.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
