RESOLUTION NO. 25-106
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, SETTING THE VOLUNTARY DONATION FEE FOR THE C.A.R.E. (CELEBRATE, ACKNOWLEDGE, REMEMBER, ENHANCE) PROGRAM FOR PARKS, BEACHES, TRAILS, SIDEWALKS, APPROVING A NEW DONATION PROGRAM FOR THE SAN CLEMENTE MUNICIPAL GOLF COURSE, SETTING THE NEW VOLUNTARY DONATION FEES, ADOPTING A RELATED POLICY AND FINDING THE ACTIONS CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CEQA GUIDELINES SECTION 15301 (EXISTING FACILITIES) AND SECTION 15311 (ACCESSORY STRUCTURES) WHEREAS, the City Council of the City of San Clemente originally adopted the C.A.R.E. Program on July 15, 2014 to provide a structured and consistent approach to the donation of public amenities in City parks; and WHEREAS, the C.A.R.E. Program offers community members an opportunity to contribute to the beautification and improvement of public spaces by voluntarily donating commemorative benches, picnic tables, and other amenities; and WHEREAS, since its inception, the program has maintained a flat voluntary donation fee of $5,000, despite increases in the cost of materials, labor, and maintenance; and WHEREAS, the Beaches, Parks and Recreation Department recommends increasing the voluntary donation amount for park benches and picnic tables to $7,000 to ensure full cost recovery; and WHEREAS, the Department also recommends expanding the C.A.R.E. Program to include a new voluntary donation opportunity at the San Clemente Municipal Golf Course, with approved amenities, including benches and drinking fountains/water refill stations; and WHEREAS, the Golf Course Committee reviewed and unanimously recommended approval of the new donation program for amenities at the Golf Course, including the proposed fees, at its May 1, 2025, meeting; and WHEREAS, participation in the C.A.R.E. Program is entirely voluntary and is not imposed as a requirement on any member of the public; and WHEREAS, a duly noticed public hearing was held on August 5, 2025 during which any member of the public wishing to be heard on the issue of setting donation fees in connection with the C.A.R.E. Program was heard; and WHEREAS, the amount of the proposed donation fees do not exceed the cost of installing and maintaining the amenities.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. That the foregoing recitals are true and correct and incorporated fully herein as findings.

SECTION 2. That it is hereby determined that the actions set forth in this resolution will result in the installation of minor park and golf course amenities (such as benches and drinking fountains) and that, based on a review of the record as a whole, such actions are hereby determined to be categorically exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15301 (Existing Facilities) and Section 15311 (Accessory Structures), as they involve the installation of minor accessory structures in existing public facilities with negligible or no expansion of use and no possibility of a direct or foreseeable indirect substantial adverse impact on the environment.

SECTION 3. That the increase in the voluntary donation amount under the C.A.R.E. Program from $5,000 to $7,000 for benches and picnic tables placed in City parks, beaches, trails, and other public spaces is hereby adopted, approved and set.

SECTION 4. That a new voluntary donation opportunity through the C.A.R.E. Program for the San Clemente Municipal Golf Course is hereby established with the donation amount for benches adopted, approved and set at $3,500 and with the donation amount for drinking fountains/water refill stations adopted, approved and set at $8,250.

SECTION 5. That Policy No. 702-8, entitled "C.A.R.E. Public Amenity Donation Program," which outlines the procedures, standards, and eligible amenities for participation in the program is hereby adopted.

SECTION 6. That this resolution shall become effective immediately upon adoption.

SECTION 7. That City staff is authorized and directed to take such actions as are necessary and proper to implement the C.A.R.E. Public Amenity Donation Program and accomplish the purposes of this resolution.

SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
