RESOLUTION NO. 25-115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, DECLARING SURPLUS AND APPROVING DISPOSITION OF RETIRED FLEET EQUIPMENT & VEHICLES, IMPLEMENTING A STAFF-MANAGED MUNICIPAL AUCTION PROGRAM FOR SELECT VEHICLES, AND AWARDING A CONTRACT FOR AUCTION SERVICES TO JJ KANE ASSOCIATES, INC.
WHEREAS, in the process of replacing aging fleet inventory, the City has accumulated a number of retired fleet vehicles and equipment that is no longer needed for City purposes; and WHEREAS, there is a need to remove retired vehicles from City property; and WHEREAS, at the April 1, 2025 City Council meeting, Council directed staff to provide greater opportunity for local residents to purchase surplus vehicles and equipment that are sold through a competitive auction process in accordance with Policy 201-2-4; and WHEREAS, staff researched potential auction service options and solicited verbal proposals in compliance with the City’s Procurement Policy; and WHEREAS, staff reviewed proposals from JJ Kane Associates, Inc., Western Construction Auctions Inc., GovDeals and Municibid; and WHEREAS, staff evaluated the solicitation results, operational cost and feasibility of each potential auction service option and determined a hybrid auction service model utilizing both a staff-managed municipal auction program and full-service auction company is in the best interest of the City; and WHEREAS, JJ Kane Associates, Inc., are qualified to perform full-service auctions, have fair and reasonable fees, and ranked highest with the most competitive all-inclusive service and pricing that align with project objectives.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitals are true and correct and incorporated fully herein as findings.
SECTION 2. That the City Council hereby authorizes and directs staff to develop a staff-managed municipal auction program for select surplus vehicles and equipment to promote resident access and participation utilizing an online auction platform.
SECTION 3. That a five-year Professional Services Agreement is hereby awarded to JJ Kane Associates, Inc., for the auctioning of select surplus vehicles and equipment.
SECTION 4. That the City Manager is authorized and directed to execute a Professional Consultant Services Agreement with JJ Kane Associates, Inc., for auction services in an amount not to exceed $75,000 at the commission rates and services fees referenced in Exhibit D of the agreement, for a term of five (5) years with five (5) additional optional one-year extensions exercisable in the City Manager’s discretion in a form substantially similar to that presented to the City Council on August 19, 2025.
SECTION 5. That the City Council hereby declares that the property listed on Exhibit A hereto, which is fully incorporated herein, is surplus property.
SECTION 6. That the City Council hereby authorizes and directs staff to dispose of the surplus property listed in Exhibit A pursuant to Policy No. 201-2-4 utilizing the services of JJ Kane Associates, Inc., and the staff-managed municipal auction program.
SECTION 7. That the City Council hereby authorizes and directs staff to execute such documents and take such other and further actions as are necessary and proper to accomplish the purposes of this resolution.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
