Minutes of Regular Planning Commission Meeting of August 6, 2025 Page 3 B. Interpretation (INT) 25-213, Development Standards for Planned Residential Districts (PRD)
A request for an interpretation from the Planning Commission regarding administrative review of projects in Planned Residential Districts.
Chair Cosgrove opened the public hearing.
Planning Technician Brendan Hanley summarized the staff report in a presentation titled, “Planned Residential Districts (PRD) Interpretation,” that is available by contacting the Planning Division. The item was agendized at the request of the Commission in the February meeting to provide history and background on PRDs and to provide staff and applicants with a clear path to approval of projects within PRD areas without Development Standards.
Staff identified four options in the report to provide direction how projects in PRDs should be reviewed:
• Option one: Relies heavily on HOA approval and administrative review.
• Option two: Retains staff discretion for significant deviations. • Option three: Presumes additions were not planned in original entitlements and will not be permitted unless the PRD is amended. • Option four: Similar to option three but allows staff approval if the HOA adopts their own standards.
Staff recommended adopting Resolution PC25-009 with the Commission's preferred interpretation inserted into Section Two of the Resolution.
Chair Cosgrove facilitated the discussion by calling on Commissioners to ask questions of staff:
• Confirmed that there are approximately 15 PRDs in the community without Design Standards or Guidelines, and a few more with standards.
• City Planner Lightfoot stated that there has been inconsistency historically with many planners allowing a project if the applicant received approval from their Homeowner Association, while some staff review consistencies within the neighborhood or identifying other similar projects that were approved when no Design Standards are available. City Planner Lightfoot also stated that the majority of properties in PRDs that have gone through the process were developed in the 1970’s and 1980’s with changes over time. • Staff is asking for a consistent process when receiving applications in PRDs.
• Chair Cosgrove explained the meaning of a “permissive standard” in our process, and acknowledged the staff’s objective to implement a process that will alleviate the need for a public hearing.
DRAFT
564
Minutes of Regular Planning Commission Meeting of August 6, 2025 Page 4 • Chair Cosgrove disclosed a meeting with City Planner Lightfoot and suggested an alternate Resolution that was presented to the Commission that proposed a framework for an administrative review by staff.
• A recommendation was presented to contact the PRD HOAs to initiate standardized Development Standards for their community that was followed by a discussion regarding staff time in managing that ask and cost for HOAs to hire a design professional create standards.
• A recommendation for DRSC to provide assistance to HOAs was discussed and determined HOA Design Standards are not in the committee’s purview.
• There was a consensus that HOAs should maintain their responsibility to their homeowners and managing the approval processes.
• Chair Cosgrove led a discussion on each option presented in the staff report that concluded by polling each option.
• Based on the role of the DRSC, assuming responsibility of HOAs and underlying liability issues, the inability to enforce Design Standards on HOAs, and given that zoning ordinances would still apply to PRDs without an HOA, the Commission selected Option 1 to be inserted into the Resolution.
IT WAS MOVED BY CHAIR COSGROVE, SECONDED BY VICE CHAIR CAMP, AND CARRIED 6-0, COMMISSIONER MCCAUGHAN ABSENT, TO ADOPT RESOLUTION PC25-009 INTERPRETION (INT) 24-233 THE PLANNED RESIDENTIAL DISTRICTS TO

C. Administrative Development Permit Report
D. Staff Reports
City Planner Lightfoot provided an update on the Miramar Theater and Bowling Alley project at North Beach and shared photos from that day, showcasing the progress on the bowling alley and theater buildings. The bowling alley area will be a food hall, and some of the original bowling alley floor was salvaged for use in the bar area. The theater building's exterior is nearing completion, with final finishes being applied. New plaster has been applied and the lights are on. There were no surviving light fixtures, but there were enough pieces to replicate them. The chandelier element was in the exterior covered roof portico. Moorish style arches flank the stage area. Moorish relates to the pointed style and dimensions of the arch.
Gothic relates to the honed wood bars at the top of the arch. The honed wood bars, location, and dimensions are all original to the building. The woodwork above is also original, simply repaired and painted.
A discussion continued with respect to a public comment letter received by Larry Culbertson, representative of the San Clemente Historical Society with respect to the use of the space no longer being a theater, preserving the exterior character of the building, and the fountain feature that covered the view of the marquee.
City Planner Lightfoot mentioned a meeting with the City Assistant Engineer that may alter the plans to allow perimeter walls consistent with the County’s safe line of sight for vehicular traffic and pedestrians. Next steps for approval have not yet been determined.
City Council Member Rick Loeffler made a comment that he would have preferred a theater, and commended everyone on maintaining the historical integrity and features as much as possible.

SECTION 3. Based on a review of the record as a whole, the City Council finds and determines that this Ordinance is exempt from the California Environmental Quality Act (CEQA). Compliance with the CCCPH is mandatory for all California Public Water Systems as defined in California Health and Safety Code section 116275(h), which includes the City’s water system. Because compliance is mandatory, there is no discretionary action being taken in this Ordinance and therefore no “project” exists within the meaning of the California Environmental Quality Act. In addition, in accordance with Section 15061(b)(3) of the CEQA Guidelines, the Ordinance is not subject to CEQA review because it can be seen with certainty that there is no possibility that the amendments to SCMC section 13.04.350 will have a significant effect on the environment.
SECTION 4. If any section, subsection, subdivision, paragraph, sentence, clause, or phrase of this Ordinance, or any part thereof, is for any reason held to be invalid, such decision shall not offset the validity of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses, or phrases be declared invalid.

CONSIDERATION OF A RESOLUTION AWARDING AND APPROVING A SOLE SOURCE
PURCHASE OF ELECTRONIC COMPONENTS IN ORDER TO RESTORE AND UPGRADE
FUNCTIONALITY FOR THE MARBLEHEAD COASTAL URBAN RUNOFF AND STORMWATER SYSTEMS FROM ONESOURCE DISTRIBUTORS CIP PROJECT NO. 14080,
AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT ..body
Fiscal Impact:
The estimated cost of $289,174 for the purchase of Allen Bradley components and installation materials is within the approved budget amount of $468,800 from the Local Drainage Facilities Fund, Account Number 033-835-45300-000-14080.
Summary:
The Marblehead Coastal Runoff Management Plan was designed to mitigate impacts of dry weather runoff and stormwater water quality in the Marblehead Coastal Development. It consists of water quality detention basins, underground storage tanks, bioswales, and trash capture devices, in order to capture dry weather flows and first flush storm flows and send them to the Water Reclamation Plant to be recycled. This project was implemented to:
Protect and Enhance Wetland Habitat
Minimize Stormwater Pollutants
Mitigate Urban Runoff
Strategically control the release of stormwater to stabilize Wastewater Treatment Plant flows during off-peak times.
Before the City Council is consideration of a resolution authorizing expenditures for Fiscal Year 2025-2026 for the purchase of various Allen Bradley electronic components and necessary parts and materials to replace and upgrade the electrical equipment with installation by City staff. The recommended purchase would be from OneSource Distributors, based on the attached Sole Source Justification document for Allen Bradley components.
Background:
The City uses Allen Bradley components for compatibility with the City’s remote telemetry (SCADA) system, and Staff recommends Allen Bradley for its functionality, reliability, ease of use, and standard for facilities. Rockwell Automation, who is the parent company of Allen Bradley, has submitted a Sole Source Justification letter (Attachment 3), advising that OneSource Distributors is the sole source distributor for Allen Bradley components in our region. 649
Meeting Date: September 2, 2025 Agenda Item: 11G.
CITY OF SAN CLEMENTE 2
Once fully operational and upgraded, staff will be able to remotely control the release of captured runoff water and first flush stormwater via the SCADA system, from the underground storage tanks and send it to the Water Reclamation Plant to be recycled for irrigation purposes, or treated and sent to the ocean outfall.
This purchase is consistent with Section XI.A.1.7 of City Policy 201-2-1 (Clearly established "Sole Source" suppliers or service providers, i.e., a single supplier who is the sole distributor, manufacturer or provider of a product or service such that there is not an acceptable substitute within a specific geographical area, i.e., Southern California or California) since OneSource Distributors is the sole source distributor for Allen Bradley components in our region. This purchase is also consistent with Section XI.A.1.7.d of City Policy 201-2-1 (Compatibility of good or service, e.g., department requires a specific piece of equipment, software or replacement part to be compatible with an existing equipment system) since Allen Bradley components are specifically compatible with the City’s SCADA system. Allen Bradley components are exclusively used in the City’s SCADA system, due to their availability, compatibility, and an active support agreement that the City has with Allen Bradley for troubleshooting their equipment.
Council Options:
Adopt Resolution No. 25-134 which will authorize the purchase of the Allen Bradley electronic components and installation materials from OneSource Distributors, a sole source vendor, for replacement and upgrade at the Marblehead Coastal Urban Runoff and Stormwater Systems, CIP Project No. 14080, and finding the project categorically exempt from the California Environmental Quality Act.
Modify and approve Resolution No. 25-134.
Continue the Item and direct staff to provide additional information. Deny the request to fund the purchase the electronic components.
Environmental Review/Analysis:
Staff recommends that the City Council determine this action to be categorically exempt from the California Environmental Quality Act (CEQA) under Class 2 (Replacement or Reconstruction, 14 CCR Section 15302) of the State CEQA Guidelines. Class 2 consists of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced, including replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.
Recommended Actions:
Staff Recommendation ..recommendation
STAFF RECOMENDS THAT the City Council adopt Resolution No. 25-134, which would:
1. Approve the expenditure for Allen Bradley electronic components for Fiscal Year 2025-26 for a total amount not to exceed $289,174; and
650
Meeting Date: September 2, 2025 Agenda Item: 11G.

CONSIDERATION OF A RESOLUTION APPROVING AN AGREEMENT FOR RIGHT OF
ENTRY CONSTRUCTION LICENSE AND FOR THE MARQUITA SLOPE RECONSTRUCTION
WORK AND
..body AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT Fiscal Impact:
There is no fiscal impact for the Agreement, there is funding for the ECDP construction in the amount of $2.6 million from Account No. 054-476-45300-000-21208, Sewer Fund, Depreciation Reserve.
Summary:
Staff, working with the appropriate parties has prepared an agreement for consideration by the City Council to bifurcate the costs and construction of slope mitigation impacting the City’s Linda Lane Pump Station, which includes a right of entry, mutual indemnification of the property owners and a covenant not to sue.
The City’s Linda Lane Pump Station has been exposed to an active landslide since July 2015.
The City initially installed a soldier pile wall to protect against debris, which was later fortified due an expansion of the landslide. The City and three property owners above the landslide entered into an interim Operating Memorandum to complete the project design to reconstruct the slope, which also included hold harmless provisions, a not to sue clause, potential shared cost percentages if the project was approved, along with a recommendation to develop a future agreement for the construction.

The California Coastal Commission (CCC) originally approved a project without protective measures, but upon further slope stability analysis, caissons and tie-backs were required. Upon submittal of the updated plans to the CCC, it was determined the project no longer met the intent of the initial CCC approval and staff was directed to resubmit a revised project.
To protect the pump station from continued slope movement and remove the failing soldier pile wall, an Emergency Coastal Development Permit (ECDP) was approved by the CCC and the City Council awarded a construction contract to Alliance Diversified Enterprises, Inc. at the August 5, 2025 meeting.
The proposed Agreement under consideration by the City Council now bifurcates the project with the City being responsible for construction of the ECDP work, the three private property owners funding construction of the CDP work, and a cost share based on land ownership percentages for the project area for landscaping.
Background:
The City’s Linda Lane Pump Station is located several hundred feet northwest of the Linda Lane cul-de-sac adjacent to the coastal trail and bluff. It is a critical facility for the conveyance of approximately one million gallons per day of untreated wastewater to the City’s Water Reclamation Plant. A bluff failure impacted the City’s pump station on or around July 1, 2015 from the property located at 259 West Avenida Marquita.
Shortly after the initial landslide, the City installed k-rails and a 60-foot long, 8-foot high soldier pile wall consisting of I-beams and wood lagging. The intent of the wall was to catch debris to protect the pump station building and was not designed to support an active landslide. Due to continued slope movement and debris, a series of projects from 2016 through 2019 were constructed to replace the wood lagging, add horizontal bracing to support the wall, extend the wall eight feet to the south, and replace the power pole and electric meter.
On March 28, 2017, the adjacent up-slope property owners requested the City collaborate to find a solution to protect the three properties at the top of the slope along with the City’s pump station.
In response, the City signed as a co-applicant for a California Coastal Development Permit Application, submitted in December 2017 to rebuild the slope with geogrid. As part of the application, the private property owner at 259 Marquita included removal of the single-family home and lowering the top of slope elevation by 10 feet to reduce the burden or weight on the slope from the soil mass.
On November 17, 2020, the City Council approved an interim Operating Memorandum with the up-slope private property owners which included: hold harmless provisions, a not to sue clause, cost-share percentages if the project was approved by CCC, and a recommendation to develop a future agreement for the construction. The CCC provided conditional project approval on October 7, 2020 with the use of geogrid for stabilizing the slope.
In response, the City Council awarded a design contract to Peters and Associates (259 West Marquita’s geotechnical engineer), which provided project consistency. Due to review by LGC Geotechnical, Inc., there were concerns regarding the slope stability during construction. Addition borings and analysis determined a design modification was needed to include caissons and tie 665

backs to provide stability for the top of the slope while the lower portion is excavated. In late 2024, upon completion of the slope and private property designs, the CCC staff stated that they would no longer support the project due to the addition of the protective measures and they recommended resubmittal of the project.
To protect the pump station and remove the failing soldier pile wall, City staff subsequently received approval for an ECDP to construct 16 caissons and 32 tiebacks directly above the pump station, with removal of the temporary soldier pile wall, keyway, and grading with geogrid fabric.
On August 2, 2025, the City Council awarded a construction contract to Alliance Diversified Enterprises, Inc. in the amount of $2,149,870 for construction of the ECDP work, which requires entry onto the up-slope private properties.
The proposed Agreement provides the City the right to construct on private property to mitigate that portion of the landslide that is directly above the pump station, while the City and private property owners continue to seek approval of a CDP for the entire project. The CDP portion of the project includes: extending the caissons and tie-backs to the north, reconstruction of the slope above the tie backs and improvement to the property at 259 W. Ave. Marquita. All CDP-related work will be funded by the up-slope private property owners. The Agreement provides the revegetation and its establishment period, which will likely be required by CCC, will be funded based upon percentage of property ownership of the project area from all parties.
