RESOLUTION NO. 25-155
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING FINAL PARCEL MAP 2025-109, LOCATED AT 214 WEST MARIPOSA WHEREAS, the property owner and subdivider, 214 Mariposa LLC, a California limited liability company and its managing member, Harold L. Alzate, owns a two-unit apartment building located at 215 West Mariposa; and WHEREAS, the subdivider applied for a Tentative Parcel Map in order to subdivide the two-unit apartment building into two condominiums; and WHEREAS, the Tentative Parcel Map 2025-109 was approved by the Zoning Administrator on October 17, 2024 through Resolution ZA 24-019; and WHEREAS, Resolution ZA 24-019 included Conditions of Approval for the subdivider to obtain California Coastal Commission approval for the proposed Final Parcel Map, City Attorney approval of Conditions, Covenants and Restrictions (CC&Rs), and obtain from all persons having any interest in existing rights of way for pipelines for the conveyance of water and the rights to all underground water; and WHEREAS, the CC&Rs have been reviewed by the City Attorney and are not finalized at this time; and WHEREAS, the subdivider has satisfied all other Conditions of Approval and offered to the City all water rights as dedicated; and WHEREAS, this project was previously found Categorically Exempt from the requirements of the California Environmental Quality Act pursuant to CEQA Guidelines Section 15315 (Class 15: Minor Land Divisions) and 15301.k (Class 1: Existing Facilities) in connection with the approval of the Tentative Parcel Map; and WHEREAS, pursuant to the provisions of the Subdivision Map Act and the City Municipal Code Chapter 16, Final Parcel Maps require City Council action for approval, denial, or modifications; and WHEREAS, on October 7, 2025, at a regular meeting of the City Council, the City Council considered approval for Final Parcel Map 2025-109.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the City Council finds that, except for payment of review fees and finalization of CC&Rs in a form acceptable to the City Attorney, Final Parcel Map 2025-109 conforms to the requirements set forth in the Subdivision Map Act and the previously approved Tentative Parcel Map.
SECTION 3. The San Clemente City Council approves Final Parcel Map 2025-109, effective upon completing the actions and obtaining the approvals set forth in Section 5 of this Resolution.
SECTION 4. The San Clemente City Council accepts on behalf of the City of San Clemente the water rights as dedicated effective upon completing the actions and obtaining the approvals set forth in Section 5 of this Resolution.
SECTION 5. That the Public Works Director/City Engineer is authorized to execute the Final Parcel Map upon verification that the CC&Rs and payment of the review fees have been completed to the satisfaction of and approved by the City Attorney and City Planner, respectively.
SECTION 6. That the City Clerk is authorized to sign and submit the Final Parcel Map for recordation with the County of Orange Recorder’s Office.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
