CONTINGENCY, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ..body ENVIRONMENTAL QUALITY ACT
Fiscal Impact:
The estimated total construction cost of $471,094 is within the approved budget of $550,000 from the General Fund, Account No. 001-416-45720-000-25303, Major Street Maintenance Program.
Summary:
Before the City Council is the award of a construction contract to Roy Allan Slurry Seal, Inc. in an amount not to exceed $370,517 and approval of a 15% project contingency for the FY 2025 Major Street Maintenance.
Background:
The FY 2025 Major Street Maintenance project includes slurry sealing, crack filling, and restriping on various streets as shown on the Location Map (Attachment 2).

On March 20, 2025, staff contacted local contractors, published a notice inviting bids for this project in the SC Times, and published a bid solicitation on PlanetBids. Bids were opened on April 10, 2025, and the results are presented in the table below. Bids ranged from $370,516.83 to $546,000.00. There were no bidders from businesses based in San Clemente.
The lowest responsive and responsible bidder is Roy Allan Slurry Seal, Inc. of Santa Fe Springs, California, with a total bid of $370,516.83.

As required by state law and City policy, Roy Allan Slurry Seal will be required to provide performance and payment bonds simultaneously with the execution of the construction contract (Attachment 3). Project plans and specifications are on file in the City Clerk’s office.
Council Options:
Adopt Resolution No. 25-52 (Attachment 1), awarding the FY 2025 Major Street Maintenance contract to Roy Allan Slurry Seal, Inc., authorizing the City Manager to execute a construction contract an amount not to exceed $370,517, approving a 15% project contingency of $55,577, and finding the project categorically exempt from CEQA under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines.
Modify and adopt Resolution No. 25-52.

Environmental Review/Analysis:
This project is exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of repairs to existing City facilities, involves negligible or no expansion of existing or former use, and has no possibility of a direct or reasonably foreseeable indirect effect on the environment.

2. Award the FY 2025 Major Street Maintenance, CIP Project No. 25303, contract to Roy Allan Slurry Seal, Inc.;
3. Authorize the City Manager to execute a contract with Roy Allan Slurry Seal, Inc. in an amount not to exceed $370,517, in a form substantially similar to Contract No. 25-18 (Attachment 3), for the FY 2025 Major Street Maintenance, CIP Project No. 25303; and
4. Approve a 15% construction contingency of $55,577 for this project. ..end
