RESOLUTION NO. 25-162
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, TO AUTHORIZE THE FIRST AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH PACIFIC RAILWAY ENTERPRISES, INC. FOR THE PEDESTRIAN AUDIBLE WARNING SYSTEM REHABILITATION PROJECT, PROJECT NO. 25505 TO EXTEND THE CONTRACT TERM UNTIL THE COMPLETION OF THE PROJECT, AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT WHEREAS, on June 7, 2024 the City successfully renewed its waiver with the Federal Railroad Administration for an additional five years ending on June 7, 2029; and WHEREAS, this waiver allows the City to enjoy the use of custom horns in place of wayside horns and train horns of passerby trains through the City; and WHEREAS, on October 15, 2024, the City Council awarded a Professional Consultant Services Agreement to Pacific Railway Enterprises, Inc. to provide the City with design of a viable replacement; and WHEREAS, the Orange County Transportation Authority (OCTA) is now providing construction funding and Southern California Railroad Authority is providing construction management; and WHEREAS, to continue providing design and construction related engineering support services, the City’s agreement with Pacific Railway Enterprises, Inc. needs to be extended.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. That an amendment to the Professional Consultant Services Agreement with Pacific Railway Enterprises, Inc. for the Pedestrian Audible Warning System Rehabilitation project to extend the contract term until the successful completion of the project is hereby approved.
SECTION 3. That the City Manager is hereby authorized to execute the First Amendment to the Professional Consultant Services Agreement with Pacific Railway Enterprises, Inc. for the Pedestrian Audible Warning System Rehabilitation in a form substantially similar to that presented to the City Council on October 21, 2025.
SECTION 4. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
