A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ADOPTING THE 2025 SEWER SYSTEM MANAGEMENT PLAN, AUTHORIZING THE CITY MANAGER AND THE UTILITIES MANAGER TO APPROVE ANY FURTHER MINOR UPDATES TO THE PLAN, DESIGNATING A LEGALLY RESPONSIBLE OFFICIAL AS REQUIRED BY THE REGIONAL WATER QUALITY CONTROLS BOARD’S WASTE DISCHARGE REQUIREMENTS AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CLASS 8 (ACTIONS BY REGULATORY AGENCIES FOR THE PROTECTION OF THE ENVIRONMENT), SECTION 15308 OF THE STATE CEQA GUIDELINES WHEREAS, the State Water Resources Control Board (State Board) adopted Order Number 2006-0003-DWQ, Statewide General Waste Discharge Requirements for Sanitary Sewer Systems; and WHEREAS, the State Board reissued WQ 2022-0103-DWQ Statewide Waste Discharge Requirements General Order for Sanitary Sewer Systems and was adopted by the State Board on December 6, 2022; and WHEREAS, the Statewide General Waste Discharge Requirements for Sanitary Sewer Systems contain provisions that require sewer collection system agencies to develop programs and plans to operate, maintain, and manage the sewer collection system to ensure adequate documentation in what the Statewide General Waste Discharge Requirements for Sanitary Sewer Systems refer to as a Sewer System Management Plan; and WHEREAS, the Statewide General Waste Discharge Requirements for Sanitary Sewer Systems requires the City designate a Legally Responsible Official that has authority to ensure the enrolled sanitary sewer system(s) complies with this Order, and is authorized to serve as a duly authorized representative; and WHEREAS, the WDRs require that the City certify to the State Board every six years that the Sewer System Management Plan is in compliance with the Statewide General Waste Discharge Requirements for Sanitary Sewer Systems; and WHEREAS, the Sewer System Management Plan must be approved and adopted by the City Council to be in compliance with the State Board regulations.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the foregoing recitals are true and correct and fully incorporated herein.
SECTION 2. That based upon its review of the entire record, including the Staff Report, any public comments or testimony presented to the City Council, and the facts outlined below, the City Council hereby finds and determines that the actions are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15308 (Class 8: Actions by Regulatory Agencies for Protection of the Environment) because they consist of actions taken by regulatory agencies, as authorized by state or local ordinance, to assure the maintenance, restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment, which allows for the operation and maintenance of existing public facilities with negligible or no expansion of use.
SECTION 3. That the 2025 Sewer System Management Plan is hereby adopted, certified and approved as presented to the City Council on October 21, 2025. The City Manager and Utilities Manager are hereby authorized and directed to submit such Plan to the State Water Resources Control Board and approve any future minor amendments mandated by the State Board regarding the Sanitary Sewer Management Plan, Sanitary Sewer Overflow Prevention Plan or the Spill Emergency Response Plan.
SECTION 4. That the Utilities Manager is hereby appointed to be the duly authorized representative and primary Legal Responsible Official for the City under the Regional Water Quality Controls Board’s Waste Discharge Requirements. As the Legally Responsible Official, the Utilities Manager has authority to certify that the Sewer System Management Plan complies with and shall ensure that the City’s enrolled sanitary sewer system(s) complies with Water Quality Order 2022-0103-DWQ and other applicable orders.
SECTION 5. That City staff is authorized and directed to take such other and further actions and certify and sign such documents as are necessary and proper to accomplish the purposes of this resolution.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
