RESOLUTION NO. 25-164
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING THE MODIFIED PEDESTRIAN REFUGE ISLAND DESIGN IMPROVEMENTS, AWARDING A CONSTRUCTION CONTRACT TO GENTRY GENERAL ENGINEERING, INC., TO PERFORM CAMINO MIRA COSTA MEDIAN ISLAND, CIP PROJECT NO. 15323, IN AN AMOUNT NOT TO EXCEED $74,846, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION 15301) OF THE STATE CEQA GUIDELINES WHEREAS, on March 4, 2025, the City Council approved Resolution 25-24 and the project design for the Camino Mira Costa Median Island, CIP Project No. 15323 (Project); and WHEREAS, the project design is proposed for slight modification by removing the ‘Pedestrian Crossing Ahead’ striping from the bike lanes and including flashing beacons on the advance warning signs ahead of the Project area; and WHEREAS, the City conducted formal competitive bidding for the Project; and WHEREAS, on October 6, 2025, the City received four responsive bids ranging from $74,846 to $119,197 for the Project; and WHEREAS, Gentry General Engineering, Inc. was the lowest responsive and responsible bidder with a bid of $74,846.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. That the above recitations are true and correct and fully incorporated herein.

SECTION 2. That based upon substantial evidence in the record as a whole, the Project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of repairs to existing City facilities, involves negligible or no expansion of existing or former use and there is no possibility of a direct or reasonably foreseeable indirect effect on the environment.

SECTION 3. That the modified design concepts for the pedestrian refuge median island and the associated improvements at the Mira Costa Park location on Camino Mira Costa are approved as presented to the City Council on October 21, 2025.

SECTION 4. That the lowest responsive and responsible bidder was Gentry General Engineering, Inc., in the amount of $74,846, and the Construction Contract Agreement for the Camino Mira Costa Median Island, CIP Project No. 15323, is hereby awarded to Gentry General Engineering, Inc.

SECTION 5. That the City Manager is authorized and directed to execute a construction contract for the Camino Mira Costa Median Island, CIP Project No. 15323 with Gentry General Engineering, Inc. in an amount not to exceed $74,846, in a form substantially similar to that presented to City Council on October 21, 2025.

SECTION 6. That the City Manager is authorized and directed to take such other and further actions as are necessary and proper to accomplish the purposes of this resolution and complete the project.

SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

PASSED AND ADOPTED this _____ day of October, 2025.
