A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING AN EXEMPTION TO THE FORMAL SOLICITATION PROCESS FOR THE PURCHASE OF PARTS TO REPAIR THE AERATION BLOWERS AT THE WATER RECLAMATION PLANT FROM AERZEN USA CORPORATION, A SOLE SOURCE VENDOR, CIP PROJECT NO. 24200, IN AN AMOUNT NOT TO EXCEED $184,000, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER SECTION 15302, CLASS 2 REPLACEMENT OR RECONSTRUCTION OF THE STATE CEQA GUIDELINES WHEREAS, the City of San Clemente operates the Water Reclamation Plant to treat the City’s wastewater; and WHEREAS, the Water Reclamation Plant blowers are in need of rehabilitation; and WHEREAS, Aerzen USA Corporation is the manufacturer and Sole Source provider of replacement parts; and WHEREAS, Section XI.A.1.7 of City Policy Number 201-2-1 (Purchasing Policies & Procedures for Supplies, Materials and Equipment) and Section XI.A.1.7.d of City Policy 201-2-1 (Compatibility of good or service, e.g., department requires a specific piece of equipment, software or replacement part to be compatible with an existing equipment system) allows for the exemption of the formal solicitation process.
NOW, THEREFORE, The City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitals are true and correct and incorporated herein as findings.
SECTION 2. That based on substantial evidence in the record as a whole, this project is categorically exempt from the California Environmental Quality Act (CEQA) under Section 15302, Class 2 Replacement or Reconstruction of the State CEQA Guidelines, because it consists of replacement of existing structures and facilities where the new structures will be located on the same site as the structures replaced, and will have substantially the same purpose and capacity as the structures replaced involving negligible or no expansion of existing or former use, and there is no reasonable possibility that the activity will have a significant direct or foreseeable indirect effect on the environment.
SECTION 3. That Aerzen USA Corporation is a sole source vendor for Aerzen blower components.
SECTION 4. Approve the purchase of the blower components and Aerzen USA Corporation based on the attached fixed price quote.
SECTION 5. That the City Manager or his designee is authorized and directed to execute such documents and take such actions as are necessary and proper to complete the purchase.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
