RESOLUTION NO. 25-175
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING THE COST OF SERVICES STUDY, ADOPTING THE COST RECOVERY FOR BEACHES, PARKS & RECREATION SERVICES POLICY AND APPROVING AND ADOPTING THE ASSOCIATED FEE SCHEDULE, AND REPEALING AND REPLACING RESOLUTION NOS. 23-25, 89-54, 95-01, 11-66, AND 16-23, AND ALL OTHER RESOLUTIONS THAT MAY CONFLICT THEREWITH, AND FINDING THE ACTIONS STATUTORILY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (“CEQA”) UNDER CEQA GUIDELINES SECTION 15273 (14 CCR § 15273) WHEREAS, the City of San Clemente last completed a comprehensive fee study for Beaches, Parks & Recreation (BPR) services in 2009, and operational costs, including labor, utilities, supplies, and maintenance, have since increased significantly; and WHEREAS, in 2025, the City retained Matrix Consulting Group to conduct a comprehensive Cost of Services Study (User Fee Study) for all BPR operations, including aquatics, recreation programming, facility rentals, and park services, to identify the full cost of service, evaluate recovery levels, and establish a fair and consistent fee framework; and WHEREAS, the study determined that the Department’s overall cost recovery level is approximately thirty-eight to forty percent, consistent with national benchmarks for municipal recreation services, and identified opportunities to enhance fiscal transparency and sustainability; and WHEREAS, the Beaches, Parks & Recreation Commission reviewed the findings and proposed Cost Recovery for Beaches, Parks & Recreation Services in their regular meetings on October 14, 2025, and again on October 28, 2025, recommending refinements to ensure equitable implementation, continued affordability for residents, and the establishment of an Aquatics Fees Subcommittee to further review pool and lane rental rates; and WHEREAS, following additional analysis and stakeholder consultation, the Commission unanimously recommended adoption of the Cost Recovery for Beaches, Parks & Recreation Services Policy (the “Policy”) and Fee Schedule as amended to reflect a phased implementation of certain aquatics fees, balancing cost recovery objectives with community access; and WHEREAS, the City Council conducted a duly noticed public hearing in accordance with California Government Code Section 66018(a), allowing public testimony and review of the Cost of Service Study, the proposed Policy and the proposed Fee Schedule; and WHEREAS, the adoption of the Cost of Service Study, Policy and Fee Schedule will provide a structured, transparent, and equitable framework for establishing and adjusting user fees, consistent with community benefit principles, fiscal stewardship, and City policy; and WHEREAS, it is necessary and appropriate to repeal and replace outdated or conflicting fee resolutions, including Resolution No. 23-25 (Recreation Fees), Resolution No. 89-54 (Beach Event Fees), Resolution No. 95-01 (Commercial Film Permit Fees), Resolution No. 11-66 (Park and Recreation Facility Fees), and Resolution No. 16-23 (Pool Facility Fees).

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. The City Council hereby approves and adopts the 2025 Cost of Services (User Fee) Study prepared by the Matrix Consulting Group as presented to the City Council on November 18, 2025; SECTION 2. The City Council hereby approves and adopts the Cost Recovery for Beaches, Parks & Recreation Services Policy No. 201-15, which is fully incorporated herein by this reference, as a formal City policy document to serve as the guiding framework for establishing, evaluating, and adjusting all fees within the Beaches, Parks & Recreation Department as presented to the City Council on November 18, 2025. The Policy shall be maintained by the Beaches, Parks & Recreation Director and made available to the public on the City’s website.

SECTION 3. The City Council hereby approves and adopts the Beaches, Parks & Recreation Fee Schedule, attached hereto as Exhibit A and incorporated fully herein by this reference, and finds and determines that such fees do not exceed the cost of providing services. The revised fees shall become effective January 1, 2026, and may be adjusted automatically annually based on the Consumer Price Index (CPI) – All Urban Consumers (LA/Long Beach/Anaheim region) as provided in the adopted Policy No. 201-15.

SECTION 4. Based on a review of the record as a whole, the City Council hereby finds and determines that the actions taken herein are statutorily exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15273 of the CEQA Guidelines (14 CCR § 15273), as the fees are established for the purpose of meeting operating expenses and maintaining existing services and facilities, and do not involve expansion or new construction that would result in a physical change to the environment.

SECTION 5. Effective January 1, 2026, the following resolutions are hereby repealed and replaced by this resolution:

Resolution No. 23-25 (Recreation Fees)
Resolution No. 89-54 (Beach Event Fees)
Resolution No. 95-01 (Commercial Film Permit Fees)
Resolution No. 11-66 (Park and Recreation Facility Fees) Resolution No. 16-23 (Pool Facility Fees)
Any other resolutions or the portions thereof that conflict with the provisions of this resolution. To the extent that any resolution or portion thereof does not conflict with this resolution, it shall remain in full force and effect.

SECTION 6. The Beaches, Parks & Recreation Director, is authorized and directed to take all actions necessary and proper to implement this resolution and to incorporate all related budget and revenue projections into the Biennial Budget.

SECTION 7. Severability. If any provision, clause, or section of this resolution is found to be invalid or unenforceable, such invalidity shall not affect the remaining provisions, which shall remain in full force and effect.

SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
