RESOLUTION NO. 25-176
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING HISTORIC PROPERTY PRESERVATION AGREEMENT 25-312 FOR THE PROPERTY LOCATED AT 121 WEST ESCALONES AND FINDING THE PROJECT IS CATEGORICALLY EXEMPT UNDER CLASS 31, SECTION 15378 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT GUIDELINES (14 CCR § 15331-HISTORICAL RESOURCE RESTORATION/ REHABILITATION) WHEREAS, the City Council of the City of San Clemente adopted Ordinance 1194 on October 15, 1977, which in Section 3, establishes procedures for property owners of designated historically significant structures to voluntarily enter into Historic Property Preservation Agreements in order to apply to receive property tax reductions as an incentive for historic preservation; and WHEREAS, on July 21, 2025, an application was submitted by Chloe Steblay, 121 West Escalones, San Clemente, CA 92672, the owner of a designated historically significant structure, to enter into an Historic Property Preservation Agreement (HPPA) for the property located at 121 West Escalones, the legal description being N TR 793 BLK 14 LOT 59, in the City of San Clemente, with Assessor’s Parcel Number 058-052-50; and WHEREAS, on September 24, 2025, the Design Review Subcommittee, which serves as the Cultural Heritage Subcommittee of the Planning Commission, reviewed the application and recommended approval of HPPA 25-312 with preservation improvement conditions; and WHEREAS, on November 4, 2025, the City Council held a duly noticed public hearing, and continued the public hearing to a date certain of November 18, 2025; and WHEREAS, on November 18, 2025, the City Council conducted the continued public hearing, and considered testimony of City staff, the applicant and property owner, and other interested parties.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE HEREBY RESOLVES AS FOLLOWS:
SECTION 1: Recitals. The above recitals are considered findings by the City Council and fully incorporated into the body of this resolution.
SECTION 2: California Environmental Quality Act Findings. Based on a review of the records as a whole, the City Council finds and determines that this historic preservation agreement is categorically exempt under Class 31, Section 15378 of the California Environmental Quality Act Guidelines (14 CCR § 15331 - Historical Resource Restoration/Rehabilitation) because it consists of preservation of a historical resource and its maintenance, repair, rehabilitation or restoration in a manner consistent with the Secretary of the Interior Standards for the Treatment of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring, and Reconstructing Historic Buildings (1995), Weeks and Grimmer.
SECTION 3: Based on the foregoing recitals and findings, and the written and oral comments, facts, and evidence presented, the City Council of the City of San Clemente, California approves HPPA 25-312.
SECTION 4: The City Council hereby authorizes and directs the City Manager to execute, and the City Clerk to record, HPPA 25-312, the HPPA for the property at 121 West Escalones, in a form substantially similar to that presented to the City Council on November 18, 2025 after the required application fee has been submitted to the City by the property owner, which shall be submitted no later than June 30, 2026.
SECTION 5: Certification. The City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
