RESOLUTION NO. 25-183
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AS COMPLETE THE STORM DRAIN GRAVITY MAIN SWGM-16135 REPAIRS, PROJECT NO. 26001 WHEREAS, on October 1, 2024, the City Council awarded a construction contract to Diamond Construction & Design for the Storm Drain Gravity Main SWGM-16135 Repairs, Project No. 26001; and WHEREAS, the work consisted of excavation and backfilling of a 28-foot deep sinkhole, replacement of 230 linear feet of the damaged storm drain line at a nominal depth, and installation of a new manhole; and WHEREAS, Diamond Construction & Design has completed the work to the satisfaction of the Public Works Director/City Engineer.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the City Council accepts as complete the Storm Drain Gravity Main SWGM-16135 Repairs, Project No. 26001 from Diamond Construction & Design.
SECTION 3. That the City Council authorizes the City Clerk to execute and record a Notice of Completion for Project No. 26001.
SECTION 4. That the City Council authorizes the City Clerk to release the payment bond for this project 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Diamond Construction & Design.
SECTION 5. That the City Council authorizes the City Clerk to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director/City Engineer in the amount of 25% of the total construction cost.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
