Reeves Booster Pump Station Bid Protest for Alliance Diversified Enterprises Inc Subject: Protest for Alliance Diversified Enterprises Inc After a Review of the Bid Documents submitted by Alliance Diversified we have identified a few items Experience:

Alliance Diversified Enterprises listed experience of jobs complete that only involve shoring and excavation. None of those projects specify a pump/booster station. As specified that "contractor must specify a minimum of 5 similar completed projects." It is our opinion that the jobs listed are not similar to the scope of a booster pump station Electrical Subcontractor:

Alliance Diversified Enterprises failed to list an electrical subcontractor. Listed subcontractors include roofers, underground piping, building, and concrete. Per Section 00100 Notice Inviting Bids 5.1 State License "All electrical work will be completed by a contractor or a sub-contractor ha.ving a valid California C-10 certification at the time of the bid opening." None of the listed subcontractors have a current C-10 contractor's license.

For these reasons RE Chaffee believes that Alliance Diversified Enterprises should be found non-responsive and the contract should go to the next responsible bidder.

Reeves Booster Pump Station Bid Protest for Armstrong Cal Builders Subject: Protest for Armstrong Cal Builders
After a Review of the Bid Documents submitted by Armstrong Cal Builders, we have identified a few items of relevance:

Experience:

Armstrong Cal Builders listed completed projects limited to park improvements, structural repairs, water main installation, and path of travel-none involving pump/booster stations or the technical mechanical steel piping central to this job. As the requirements state that contractors must list at least five similar projects, we believe their submissions do not match the scope of a booster pump station.

As an additional reference, upon reviewing the Armstrong Cal Builders company website, it appears that their operations are primarily oriented towards residential and commercial projects, with no indication of involvement in public works or water infrastructure.

Electrical Line Items:

Armstrong Cal Builders has proposed a total of $725,000 for items 14-17, including integration, electrical gear, wire, and all other electrical installations on the project. The OneSource Gear Package, the only approved vendor for San Clemente, is priced at $427,000, and integration along with other major electrical components amount to $248,000, which together total $675,000. This leaves $50,000 allocated for installation of wire, conduit, lighting, and other electrical installations. Based on these figures, it appears that there may be required electrical components not included as per the specifications.

For these reasons RE Chaffee believes that Armstrong Cal Builders should be found non-responsive and the contract should go to the next responsible bidder.

City of San Clemente – Utilities Department Date:10/21/2025 Attn: Amir Ilkhanipour, Principal Civil Engineer
910 Calle Negocio
San Clemente, CA 92673
Subject: Bid Protest – Reeves Booster Pump Station Project No. 17405 Dear Mr. Ilkhanipour,
Armstrong Cal Builders, Inc. hereby submits this formal bid protest regarding the apparent low bidder, Alliance Diversified Enterprises, Inc. (ADEI), for the above-referenced project. Based on our review of the bid documents, specifications, and subsequent addenda, ADEI’s bid is non-responsive and should be disqualified for the reasons summarized below.

1. Failure to List Required C-10 Licensed Electrical Subcontractor Section 00100 – Notice Inviting Bids, paragraph 5.1, clearly requires that:
“All electrical work will be completed by a contractor having a valid California C-10 certification at the time of the bid opening.”
ADEI’s submitted bid (see attached ADEI – Reeves Booster Pump Bid) did not list any C-10 licensed electrical subcontractor on the List of Subcontractors form (Section 00440). This is a material omission under Public Contract Code §4104 and §3300, rendering the bid non-responsive. A subcontractor required to hold a C-10 license cannot be added or substituted after bid opening.

Furthermore, Section 00200 – Instructions to Bidders provides that the award shall be made to the lowest “responsive and responsible” bidder. A bidder omitting required subcontractor listings and license categories fails to meet both criteria, and the City is obligated to reject such a bid as non-responsive.

2. Failure to Identify Certified Control System (SCADA) Personnel Appendix E – San Clemente SCADA and Electrical Standards requires that all PLC, HMI, and network integration be performed by manufacturer-certified technicians approved by the City. Specifically:
“Motor Control Center PLC / Control Panel shall be built and assembled by Rockwell Automation according to design on the contract control diagram.”
Further reinforced in Addendum No. 2, Q&A #1, which states:
“To ensure compatibility with existing City SCADA equipment, the PLC/SCADA panel, including all software programming and start-up services, shall be furnished by Rockwell Automation. There shall be no deviation from this requirement.”
As Addendum No. 2 is a binding clarification to all bidders, ADEI’s failure to list a manufacturer-certified Rockwell Automation technician or qualified integrator constitutes a direct violation of the bid requirements and a material deviation from the contract documents.

Under California Public Contract Code §10162 and §10163, bidders must demonstrate the competence, experience, and technical ability to perform specialized work. By failing to identify certified control system personnel, ADEI has not demonstrated the necessary technical qualifications and therefore cannot be deemed a “responsible bidder.” Public & Private Sector | Commercial, Residential, Design-Build 8031 Main St, Stanton, CA 90680 | Office: (657) 332-2300 |www.armstrongcalbuilders.com | CSLB #990992 – B, A | DIR #1000885560

3. Subcontractor Listing Value Threshold and Section 00440 Requirements Section 00440 – List of Subcontractors of the specifications clearly states:
“Each bidder shall set forth the name and location of the place of business of each subcontractor who will perform work or labor or render service to the prime contractor in an amount in excess of one-half of one percent (0.5%) of the total bid.”
Despite this requirement, ADEI’s bid package does not list any C-10 electrical subcontractor or certified control system technician. Given that the electrical and SCADA portions of the work clearly exceed the 0.5% threshold, both must be listed.

Additionally, because the project specifications (Appendix E) and Addendum No. 2 require that the control integrator be manufacturer-certified, the omission of such personnel or subcontractor further violates the listing and technical qualification requirements. Allowing this omission would create an unequal bidding condition, placing compliant bidders at a competitive disadvantage, contrary to Public Contract Code §100 and §10122 which mandate fairness and integrity in public bidding.

4. Lack of Response to Public Bid Document Request
On September 25, 2025, at 3:01 PM, we sent an email to the City requesting a copy of the bid documents for the lowest bidder for review. As of today’s date, we have not received any response or the requested documents. (See attached copy of the email correspondence for reference.) This lack of response has limited our ability to verify the completeness of the lowest bidder’s submittal, but even from the documents available, the omissions noted above are evident and material.

5. Conclusion and Protest Request
Based on the foregoing, ADEI’s bid does not meet the requirements of the specifications or California Public Contract Code, and must therefore be deemed non-responsive. We respectfully request that the City of San Clemente:

1. Reject the bid submitted by Alliance Diversified Enterprises, Inc. as non-responsive; and

2. Furthermore, based on the information contained within the bid documents and specifications, Armstrong Cal Builders, Inc. should be recognized as the first responsive and responsible lower bidder. Our bid fully complies with all requirements of Section 00440 – List of Subcontractors, as well as Appendix E – SCADA and Electrical Standards, including the requirement that the control system work be performed by manufacturer-certified personnel. Accordingly, we respectfully request that the City reject the ADEI bid as non-responsive and proceed to award the project to Armstrong Cal Builders, Inc. as the next responsive and responsible low bidder.

This protest is submitted in good faith and within the prescribed time period following the bid opening, in accordance with the City’s protest procedure and the California Public Contract Code. Armstrong Cal Builders, Inc. has direct standing as an affected bidder.

By allowing ADEI’s bid to stand despite omitting required licensed and certified personnel, other bidders who complied in good faith are placed at a competitive disadvantage, undermining the fairness and integrity of the competitive bidding process.

Given the seriousness of these deficiencies, we respectfully request that this protest be reviewed by the City Attorney prior to any recommendation of award to ensure compliance with applicable Public Contract Code provisions.
