A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE JOINT REGIONAL WATER SUPPLY SYSTEM (JRWSS) CROWN VALLEY PARKWAY TRANSMISSION MAIN RELOCATION PROJECT QUITCLAIM DEEDS FOR PORTIONS OF WATER TRANSMISSION PIPELINE EASEMENT CONVEYED IN INSTRUMENT NO. OR5746-657 WHEREAS, the Joint Regional Water Supply System (JRWSS) water transmission pipeline was constructed in 1961 to convey potable water from a Metropolitan Water District connection in Irvine, to water agencies serving communities from Irvine to San Clemente, including the California State Parks, San Onofre Nuclear Generating Station, and USMC Camp Pendleton in northern San Diego County. The JRWSS system also includes two water storage facilities in San Clemente; collectively, these facilities comprise the JRWSS and are contract-operated by South Coast Water District; and WHEREAS, the Crown Valley Parkway Transmission Main Relocation Project constructed approximately 2,500 lineal feet of 36-inch cement mortar lined and coated (CML&C) steel water transmission pipe in Crown Valley Parkway, new corrosion protection improvements, and abandoned the 36-inch and 39-inch pipes originally constructed in 1961. The contractor filled the abandoned pipe with lightweight cellular concrete and installed caps on the open ends of the pipe for permanent abandonment; and WHEREAS, construction was completed on July 2, 2025, with a Notice of Completion recorded at the County of Orange on August 18, 2025. In its capacity as the Designated Operator on behalf of the JRWSS, the SCWD Board of Directors at their Regular Meeting on August 14, 2025, by 5-0 vote, authorized the General Manager to execute the filing of a Notice of Completion and Release of Retention Fund for the JRWSS Crown Valley Parkway Transmission Main Relocation Project; and WHEREAS, the Joint Transmission Main (JTM) was originally constructed in a 25-foot-wide Easement granted by the Laguna Niguel Corporation and recorded on June 7, 1961 (Instrument No. OR5746-657, Book 5746, Page 657, of the Official Records of the County of Orange). Tract No. 5182, recorded on October 3, 1963, created the currently existing residential subdivision and encumbered nineteen (19) parcels with the Easement. The parcels encumbered by the Easement are generally located in the area between Crown Valley Parkway, Paseo Del Valle and Paseo Del Niguel; and WHEREAS, the existing JRWSS facilities within the Easement in Tract No. 5182 have been abandoned in place and it is not foreseen that there is a need to retain the existing Easement to construct new facilities in the future; and WHEREAS, execution of the Joint Regional Water Supply System (JRWSS) Crown Valley Parkway Transmission Main Relocation Project Quitclaim Deeds for Portions of Water Transmission Pipeline Easement Conveyed in Instrument No. OR5746-657 is in the best interests of the City and the public.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
