RESOLUTION NO. 25-199
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AN EXEMPTION TO THE CITY’S PURCHASING POLICIES AND PROCEDURES, AWARDING AGREEMENT FOR THE ANALYSIS OF THE CITY’S BEACH TRUNK LINE TO THE REGENTS OF THE UNIVERSITY OF CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT, AUTHORIZING A SUPPLEMENTAL APPROPRIATION IN THE AMOUNT OF $70,000 FROM THE SEWER FUND DEPRECIATION RESERVE, AND FINDING THE ACTIONS CATEGORICALLY EXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 6 OF THE STATE CEQA GUIDELINES SECTION 15306 (14 CCR SECTION 15301, INFORMATION COLLECTION) WHEREAS, the City owns and operates a wastewater collection system consisting of 180 miles of sewer lines and 12 pump stations; and WHEREAS, the City is required to analyze alternatives to the City’s Beach Trunk Line, as part of a California Coastal Commission Development Permit for the relocation of Cyprus Shore Pump Station; and WHEREAS, University of California Irvine is interested in partnering with the City to provide engineering experience for its Masters of Engineering Students to evaluate relocation of the City’s Beach Trunk Line; and WHEREAS, the City and Regents of the University of California wish to enter into an agreement providing three alternatives, cost estimates, hydraulic analysis, presentations and funding for the project to be used as part of the City’s requirement to fulfill an existing Coastal Development Permit, which is in the best interest of the public and the City; and WHEREAS, Section XI.A.1.1.5 of Procurement Policy and Procedure No. 201-2-1 (Purchasing Policies and Procedures) allows the City Council to authorize an exemption to the formal and informal solicitation process for “Services and/or supplies obtained from or through agreement with any governmental, public or quasi-public entity”; WHEREAS, the Regents of the University of California is a public or quasi-public entity and there is no reasonable possibility of obtaining better prices commensurate with the time and effort expended.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. That the above recitations are true and correct and fully incorporated herein as findings.

SECTION 2. That based on a review of the entire record as a whole, these actions are hereby determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Class 6 of the state CEQA Guidelines Section 15306 (14 CCR Section 15301, Information Collection) because they consist of data collection, information gathering as part of a study leading to an action which a public agency has not yet approved, adopted or funded.

SECTION 3. That a supplemental appropriation in the amount of $70,000 from the Sewer Fund Depreciation Reserve to Account Number 054-473-43690-000-00000 is hereby approved.

SECTION 4. That the City Council authorizes an exemption to the formal and informal solicitation process pursuant to Section XI.A.1.1.5 of Procurement Policy and Procedure No. 201-2-1 for services obtained through an agreement with a public or quasi-public entity and because of the unique educational nature of the project and benefits to the City and the public and the lack of a reasonable possibility of obtaining better prices commensurate with the time and effort expended.

SECTION 5. That an agreement for the Analysis of the City’s Beach Trunk Line is hereby awarded to the Regents of the University of California in an amount not to exceed $70,000.

SECTION 6. That the City Manager is hereby authorized and directed to execute said agreement in form substantially similar to that presented to the City Council on December 9, 2025.

SECTION 7. That the City Manager is authorized and directed to take such actions and execute such other and further documents as may be necessary to accomplish the purposes of this resolution and complete the study.

SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
