RESOLUTION NO. 25-202
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING THE FIRST AMENDMENT TO A PARKING LOT SUBLEASE AGREEMENT (CONTRACT C09-16) WITH THE FRANK H.C. NAM BYPASS TRUST FOR THE REAL PROPERTY LOCATED AT 103 AND 107 AVENIDA GRANADA, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT WHEREAS, the City of San Clemente (“City”) entered into a Parking Lot Sublease Agreement with the Nam Family Trust on March 17, 2009 (“Agreement”), for the continued operation and use of a parking lot to support public parking needs in the downtown area; and WHEREAS, on February 12, 2021, an Assignment and Assumption Agreement was executed, transferring all rights and obligations under the Agreement to the Frank H.C. Nam Bypass Trust dated December 12, 2018 (“Sublessor”); and WHEREAS, the Sublessor has requested an increase in the monthly lease rate effective January 1, 2026, along with an annual lease rate adjustment not to exceed three percent (3%) per year; and WHEREAS, the continued availability of this parking facility is beneficial to the City’s downtown parking initiatives and supports adequate public parking resources for residents, visitors, and local businesses; and WHEREAS, approving the proposed lease rate adjustment is in the best interest of the City and the community.
NOW THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. The City Council hereby approves the Amendment to the Parking Lot Sublease Agreement with the Frank H.C. Nam Bypass Trust dated December 12, 2018, adjusting the lease rate to $900 per month effective January 1, 2026, and authorizing future annual rent increases not to exceed three percent (3%) per year.
SECTION 2. The City Council hereby authorizes and directs the City Manager to execute such Amendment in a form substantially similar to the presented to the City Council on December 9, 2025.
SECTION 3. The City Council hereby authorizes and directs the City Manager to execute such additional documents and take such other and additional actions as are necessary and proper to carry out the purpose of this resolution.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
