In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. Section 1542 provides as follows:

RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER

In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. Section 1542 provides as follows:

In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. Section 1542 provides as follows:

In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. Section 1542 provides as follows:

_____ Computed on full value less liens and encumbrances remaining at time of sale. _____ Unincorporated area _____ City of _______________________________ For valuable consideration, receipt and sufficiency of which is hereby acknowledged, (1) South Coast Water District, a local public agency organized and operating pursuant to Division 12 of the California Water Code (section 30000 et seq.) and its successors and assigns; (2) Moulton Niguel Water District, a California Water District organized and operating pursuant to Division 12 of the California Water Code (Section 30000 et seq.) and its successors and assigns; and (3) City of San Clemente, a municipal corporation and its successors and assigns ((1)-(3) are collectively referred to herein as “Grantors”) hereby REMISE(S), RELEASE(S) AND QUITCLAIM(S) to JAMIE LEAVITT AND JASON LEAVITT and his/her/its/their successors and assigns (“Grantee”), that certain portion of easement located in the County of Orange, State of California, as more particularly described in that certain Easement recorded as Instrument No. OR5746-657 of the Official Records of the County of Orange, on June 7, 1961 (the “Easement”), together with the pipeline and appurtenances to such pipeline that are located within, upon, under, over or across such Easement and that certain portion of real property (collectively the “Property”) situated in the County of Orange, State of California, which portions are more particularly described in Exhibit “A” and depicted in Exhibit “B” attached hereto and fully incorporated herein.
In consideration for Grantors’ quitclaim of the Property to Grantee, Grantee hereby agrees to release, defend (with counsel acceptable to Grantors), indemnify, and hold harmless Grantors and their respective officials, employees, officers, directors, authorized volunteers and agents from any and all claims, losses, causes of action, suits, proceedings, demands, expenses, damages, or costs, including costs and attorney and expert fees in connection with litigation (“Claims”) that may arise out of or in connection with this Quitclaim Deed, the Property, or Grantee’s use or misuse of the Property, except Claims caused by the sole gross negligence or sole willful misconduct of Grantors. Grantee understands, intends, and expressly agrees that all rights under Section 1542 of the California Civil Code and any similar statute/legal doctrine are expressly waived in connection with the foregoing release. Section 1542 provides as follows:

OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
