The Outlets at San Clemente are within the Regional Commercial (RC1) zoning designation of the Marblehead Coastal Specific Plan. NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. Incorporation of Recitals.
The City Council hereby finds that all of the facts in the Recitals are true and correct and are incorporated and adopted as findings of the City Council as if fully set forth in this resolution.
SECTION 2. CEQA Findings.
The project is Categorically Exempt from the requirements of the California Environmental Quality Act pursuant to CEQA Guidelines Section 15301, Class 1(e) (14 CCR §15301, Existing Facilities), in that the modification to the existing Conditional Use Permit to add additional conditions of approval are consistent with the types of conditions currently placed on the event and represent no expansion of the event or approvals for any increase in the event intensities.
SECTION 3. Findings to Modify CUP 22-328
The City Council finds that the event operations currently meet the following criteria under San Clemente Municipal Code Section 17.12.175 - City Initiated Changes or Revocation of Approved Applications: The site or land use is being operated in a manner that constitutes a nuisance. Evidence of pedestrian trespass and loitering near freeway ramps as well as records of elevated vehicle code infractions near the site both before and after the event indicate that there are nuisance and safety concerns that may be improved by the imposition of additional Conditions of Approval.
SECTION 4. Additional Conditions of Approval
The Conditions of Approval for Conditional Use Permit 22-328 remain operative. In addition, the following conditions are hereby imposed in order to remedy the identified vehicular safety and nuisance concerns:
The event operator shall enter into a private contract with San Clemente Police Services (OCSD) to provide two (2) Deputies at 6 hours each who would be assigned to patrol the public right-of-way around the Cars and Coffee event, including the hour before and the hour after the end of the event. Such contract shall be maintained for all “Cars and Coffee” events.
Motorcycles shall not be permitted within the Cars and Coffee event area. The event organizers and Outlets at San Clemente property management shall be responsible to ensure compliance with this condition.
By April 20, 2026, the event operator and/or property owner shall be responsible for the installation of two (2) Automatic License Plate Reader (ALPR) cameras at both entrances/exits to the Outlets property along Avenida Vista Hermosa (four (4) ALPR cameras in total), in a manner recommended by San Clemente Police Services (OCSD) and providing network access to those ALPR cameras to OCSD.
SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
