Dear Mr. KnoblockThank you for your continued consideration and attention to the tree height restrictions and enforcement issues on Calle Delicada and Broadmoor HOA. We are respectfully requesting the City of San Clemente assume the enforcement of the 17-foot height limit due to Broadmoor HOA’s lack of enforcement over the last 10+years.
As documented, the City imposed the height restriction as a Condition of Approval tied directly to concessions Felicidad homeowners made to enable the homes on Delicada to be built. In addition, the City further required Broadmoor to incorporate this condition into the Supplemental CC&Rs as additional protection to Felicidad homeowners. Felicidad continues to act in good faith; however, Broadmoor has done little to enforce its own CC&Rs. The Council’s March 18, 2024 directive that the violations be abated expeditiously, on their face without Broadmoor’s subjective assessment has not been met. To date, there are more than 30 violations to the height restriction. As a non-HOA community, we rely on the City to uphold its approved conditions.
In summary, when the subject of height restriction enforcement is addressed at the upcoming January 20, 2026 meeting, we respectfully request the City to take over enforcement as Broadmoor has clearly demonstrated it will not enforce the restriction as agreed to and added to the Broadmoor HOA Supplemental CC&Rs February 11, 1976 (Article VII, Section 22). Felicidad homeowners have been working to resolve the height violations with Broadmoor HOA for many months without resolution and unfortunately, now require the City to enforce the agreement following much effort on our part to work with the Broadmoor HOA.
Respectfully,
Elise Kushino and Kal Kouatli
