RESOLUTION NO. 26-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A LICENSE AGREEMENT WITH THE HERITAGE OF SAN CLEMENTE FOUNDATION FOR THE INSTALLATION AND OPERATION OF A SECURITY CAMERA AT PARK SEMPER FI, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND RELATED EXTENSIONS, AND FINDING THE ACTIONS CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (“CEQA”) PURSUANT TO CEQA GUIDELINES TITLE 14, SECTIONS 15301 (CLASS 1 - EXISTING FACILITIES) AND/OR 15303 (CLASS 3 - NEW CONSTRUCTION OR CONVERSION OF SMALL STRUCTURES) WHEREAS, the City of San Clemente (“City”) owns and operates Park Semper Fi, located at 106 Alameda Lane, which is open to the public; and WHEREAS, the City and the Heritage of San Clemente Foundation (“Foundation”) are parties to an approved Partnership Agreement/Memorandum of Understanding, Partnership Agreement No. C08-45, pursuant to which the Foundation supports historical preservation, stewardship, and community-oriented activities at Park Semper Fi; and WHEREAS, the Foundation has requested authorization to install, operate, monitor, and maintain a security camera at an approved location within Park Semper Fi in response to a recent theft of a significant historic bronze plaque near the Marine Monument, and to enhance protection of historic resources and public amenities; and WHEREAS, a proposed License Agreement has been prepared that authorizes the installation and operation of the camera at no cost to the City, requires the Foundation to bear all installation, monitoring, maintenance, and utility costs, establishes privacy and technology limitations, provides for City access to recorded footage, and preserves City ownership and control of the property; and WHEREAS, the City Council has reviewed the proposed License Agreement and finds that authorizing the Foundation to install and operate a camera at Park Semper Fi will enhance public safety and protection of City assets while maintaining transparency, privacy safeguards, and appropriate City oversight.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. The City Council hereby approves the License Agreement between the City of San Clemente and the Heritage of San Clemente Foundation authorizing the installation, operation, and maintenance of a security camera at a City-approved location within Park Semper Fi for an initial term of four (4) years, with up to three (3) additional two-year extensions.

SECTION 2. The City Manager, or designee, is hereby authorized and directed to execute the License Agreement in a form substantially similar to that presented to the City Council on February 3, 2026.

SECTION 3. The City Manager, or designee, is hereby authorized on behalf of the City to extend the Agreement in accordance with its terms of the Agreement, in his/her discretion and subject to continued compliance by the Foundation with the Agreement’s terms.

SECTION 4. Based on a review of the record as a whole, the City Council finds that the action approved by this resolution is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Title 14, Sections 15301 (Class 1 - Existing Facilities) and/or 15303 (Class 3 - New Construction or Conversion of Small Structures), as the project involves the minor installation of equipment with no expansion of use and no potential for significant environmental impact.

SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
