RESOLUTION NO. 26-32
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN EMERGENCY LETTER AGREEMENT AND A COOPERATIVE AGREEMENT WITH ORANGE COUNTY TRANSPORTATION AUTHORITY (OCTA) TO INSTALL AND MANAGE A TEMPORARY SEWER BYPASS, IN AN ESTIMATED AMOUNT OF $690,911; APPROVING AN EXEMPTION TO THE FORMAL BIDDING PROCESS DUE TO A BONA FIDE EMERGENCY, AWARDING AN EMERGENCY CONSTRUCTION CONTRACT TO VORTEX SERVICES, LLC DBA SANCON TECHNOLOGIES, FOR THE INSTALLATION OF A CURED-IN-PLACE PIPE (CIPP) LINER IN AN AMOUNT NOT TO EXCEED $247,008; AND FINDING THE PROJECT STATUTORILY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER SECTION 15269(B) OF THE CEQA GUIDELINES (14 CCR 15269(B)) FOR EMERGENCY REPAIRS WHEREAS, the City owns and operates a wastewater collection system consisting of 180 miles of sewer lines and 12 pump stations; and WHEREAS, a portion of the City’s Beach Trunk Line south of Mariposa Beach Access is damaged and in need of replacement as shown in a video taken by the OCTA’s prime contractor Condon Johnson, currently constructing improvements to Area Three (catchment wall and beach trail) within OCTA’s right-of-way; and WHEREAS, approximately 165 feet of 21-inch wastewater collection Beach Trunk Line requires immediate action to prevent a sewer spill; and WHEREAS, OCTA and Condon Johnson possess the necessary railroad permits to quickly install and manage a temporary sewer bypass for the installation of a cured-in-place pipe (CIPP) and minimize delays, which is in the best interest of the public and the City; and WHEREAS, the City obtained a quote from Vortex Services, LLC, DBA Sancon Technologies, who possesses the ability to quickly install the CIPP liner for the repair and minimize delays, which is in the best interest of the public and the City; and WHEREAS, on December 9, 2025, the City Council adopted Resolution No. 25-205, determining that replacement of the City’s Beach Trunk Sewer Line was exempt from the California Environmental Quality Act (CEQA), approved a supplemental appropriation in the amount of $1.6 million to fund the project, approved an exemption to the formal bidding process due to a bona fide emergency, authorized the City Manager to negotiate, finalize and execute an emergency agreement to reimburse OCTA for Condon Johnson to the pipeline replacement and directed the City Manager to report the final agreement back to the City Council; and WHEREAS, following City Council direction, OCTA, CJA, and City staff further evaluated the costs and options to replace the sewer line, install a new force main from the Linda Lane Pump Station around the failed section, or install a liner and determined that to minimize project delays and provide a cost-effective solution, lining approximately 165 feet of sewer liner is the best option; and WHEREAS, OCTA and the City intend that OCTA will install and manage a temporary sewer bypass while the City installs a lining for approximately 165 feet of 21-inch sewer line within OCTA’s right-of-way; and WHEREAS, approval of emergency contracts and purchases is authorized when there is a need to protect public health and safety per the City’s Procurement Policy and Procedure Section XI.A.1.1 and per Section 3.40.070 of the City of San Clemente Municipal Code.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:

SECTION 1. That the above recitations are true and correct and fully incorporated herein as findings; and SECTION 2. That, based upon substantial evidence in the record as a whole, the project is categorically exempt from the California Environmental Quality Act (CEQA) under Section 15269(b) of the CEQA Guidelines (14 CCR 15269(b)) for emergency repairs; and SECTION 3. That an emergency exists due to the potential failure of an existing 21-inch Beach Trunk Sewer Line, and that the situation requires immediate action to prevent or mitigate impairment to property and public services that might otherwise occur if the City were required to incur delays attributed to the typical engineering analysis and formal bidding processes. The City Council hereby approves an exemption to the formal bidding process due to a bona fide emergency; and SECTION 4. The City Manager is hereby authorized and directed to negotiate and execute a letter agreement to reimburse OCTA to manage and install a temporary sewer bypass, in an amount estimated at $690,911; and SECTION 5. The City Manager is hereby authorized and directed to negotiate and execute a Cooperative Agreement with OCTA with key terms similar to those of the letter agreement and in a form approved by the City Attorney; and SECTION 6. That an emergency Construction Contract Agreement for the Beach Trunk Sewer Line Repair, CIP Project No. 26213, is hereby awarded to Vortex Services, LLC DBA Sancon Technologies; and SECTION 7. That the City Manager is authorized and directed to execute a construction contract for the Beach Trunk Sewer Line Repair, CIP Project No. 26213, with Vortex Services, LLC DBA Sancon Technologies, in an amount not to exceed $247,008; and SECTION 8. The City Manager is hereby authorized and directed to execute such other documents and take such other and further actions as are necessary and proper to accomplish the project and fulfill the purposes of this resolution; and SECTION 9. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions; and PASSED AND ADOPTED this _____ day of February, 2026.
