A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A PARTIAL FEE WAIVER FOR CHRIST LUTHERAN CHURCH’S “BEACH CHURCH” SUNDAY SERVICES AT NORTH BEACH FOR CALENDAR YEAR 2026 WHEREAS, Christ Lutheran Church has conducted weekly Sunday “Beach Church” services at North Beach for several years pursuant to City-issued permits and prior City Council authorization allowing recurring weekly use of the beach; and WHEREAS, Christ Lutheran Church has historically paid all required permit fees in full and has remained in good standing with the City; and WHEREAS, effective January 1, 2026, the City’s Beaches, Parks & Recreation Department implemented an updated fee schedule consistent with the City’s Cost of Services Recovery Policy, increasing the total permit cost for the 2026 calendar year to $14,892; and WHEREAS, Christ Lutheran Church has requested a one-time partial fee waiver for calendar year 2026, limited to the site use fee and late filing fee components only in the amount of $10,358, citing financial hardship associated with the updated fee schedule, while affirming its ability to pay the one-time application fee and weekly amplified sound permit fees; and WHEREAS, the City Council finds that payment of the application fee and amplified sound permit fees aligns with the historical cost of the permit prior to the 2026 fee schedule update and allows the applicant time to plan and budget for future years; and WHEREAS, the City’s Cost of Services Recovery Policy authorizes the City Council to approve partial fee waivers when recovery of the full cost would result in financial hardship and when such action is consistent with City objectives, public benefit, and equitable access to City facilities and is in the best interests of the City and the community.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. The above recitals are true and correct and incorporated fully herein as findings.
SECTION 2. Approval of Partial Fee Waiver. The City Council hereby approves a partial fee waiver for Christ Lutheran Church’s weekly Sunday “Beach Church” services at North Beach for the 2026 calendar year, limited solely to the site use fee and late filing fee components of the permit in the amount of $10,358.
SECTION 3. Fees Not Waived. Christ Lutheran Church shall remain responsible for payment of the one-time application fee and weekly amplified sound permit fees in accordance with the City’s adopted fee schedule.
SECTION 4. Non-Precedent. This approval is based on the specific facts and circumstances presented and shall not be construed as establishing a precedent for future fee waiver requests or as a modification of the City’s adopted fee schedules or Cost of Services Recovery Policy.
SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
