RESOLUTION NO. 26-42
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AN AMENDED AND RESTATED NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORMWATER PERMIT IMPLEMENTATION AGREEMENT WHEREAS, since 1990, the City has participated in an NPDES Stormwater Permit Implementation Agreement with the County of Orange and other regulated cities within Orange County; and WHEREAS, the Orange County NPDES Stormwater Permit Implementation Agreement was amended in 1993 and again in 2002 to add newly incorporated cities and clarify program responsibilities; and WHEREAS, there is a need to amend and restate the Agreement once again to address the most recent and increasingly stringent regulatory requirements, to provide opportunities for local watershed-based planning and cost-sharing, and to formalize consultation on annual budget approvals with the Orange County City Managers Association; and WHEREAS, with input from city managers, city attorneys, and stormwater program managers from throughout the County, the County of Orange has provided a newly Amended and Restated NPDES Stormwater Permit Implementation Agreement for approval and signature by each of the stormwater permittee cities in the County, which is in the best interests of the City.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and hereby incorporated fully herein.
SECTION 2. That the City Council approves the Amended and Restated NDPES Stormwater Permit Implementation Agreement as presented on March 3, 2026, which shall replace the 2002 iteration of the Agreement.
SECTION 3. That the Mayor is authorized and directed to execute the Amended and Restated NDPES Stormwater Permit Implementation Agreement in a form substantially similar to that presented to the City Council on March 3, 2026.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
