RESOLUTION NO. 26-52
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO ALL AMERICAN ASPHALT TO PERFORM ARTERIAL PAVEMENT PRESERVATION PROGRAM FOR SOUTH EL CAMINO REAL (W. AVE. GAVIOTA TO W. AVE. SAN ANTONIO) IN AN AMOUNT NOT TO EXCEED $332,218, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION 15301) OF THE STATE CEQA GUIDELINES WHEREAS, the City conducted formal competitive bidding for the Arterial Pavement Preservation Program for South El Camino Real (W. Ave. Gaviota to W. Ave. San Antonio), CIP Project No. 12303 (Project); and WHEREAS, on February 19, 2026, the City received eight responsive bids ranging from $332,218 to $398,973 for the Project; and WHEREAS, All American Asphalt was the apparent low bidder with a minor irregularity in its bid.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. That based upon substantial evidence in the record as a whole, the Project is hereby determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of repairs to existing City facilities, involves negligible or no expansion of existing or former use and there is no possibility of a direct or reasonably foreseeable indirect effect on the environment.
SECTION 3. That the minor irregularity made in All American Asphalt’s bid was inconsequential, provided no unfair competitive advantage and is hereby waived. All American Asphalt is hereby determined to be the lowest responsive and responsible bidder with a bid of $332,218.
SECTION 4. That the Construction Contract Agreement for the Arterial Pavement Preservation Program for South El Camino Real (W. Ave. Gaviota to W. Ave. San Antonio), CIP Project No. 12303, is hereby awarded to All American Asphalt.
SECTION 5. That the City Manager is authorized and directed to execute a construction contract for the Arterial Pavement Preservation Program for South El Camino Real (W. Ave. Gaviota to W. Ave. San Antonio), CIP Project No. 12303 with All American Asphalt in an amount not to exceed $332,218, in a form substantially similar to that presented to City Council on March 17, 2026.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
PASSED AND ADOPTED this _____ day of March, 2026.
