RESOLUTION NO. 26-70
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A THREE-YEAR PROFESSIONAL SERVICES AGREEMENT TO FIREWORKS & STAGE FX AMERICA, LLC FOR THE PRODUCTION OF THE CITY’S ANNUAL FOURTH OF JULY FIREWORKS SHOW, AUTHORIZING THE CITY MANAGE TO EXECUTE THE AGREEMENT AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 23 OF THE CEQA GUIDELINES, SECTION 15323 (NORMAL OPERATIONS OF FACILITIES FOR PUBLIC GATHERINGS, 14 CCR 15323) WHEREAS, the City of San Clemente hosts an annual Fourth of July fireworks show as part of the City’s Independence Day celebration, which is a longstanding community tradition and one of the City’s most highly attended annual events; and WHEREAS, the City contracts with a licensed professional pyrotechnics operator to design and execute the fireworks display in compliance with all applicable federal, state, and local safety regulations; and WHEREAS, the City released a Request for Proposals through the City’s PlanetBids procurement system seeking proposals from qualified fireworks production companies capable of producing the City’s annual fireworks show; and WHEREAS, one proposal was received prior to the submission deadline from Fireworks & Stage FX America, LLC; and WHEREAS, staff reviewed the proposal and determined it to be responsive to the City’s Request for Proposals and that the firm is well qualified to perform the services based on its experience, safety record, and familiarity with the City’s operational requirements; and WHEREAS, staff further determined that the proposed pricing is fair and reasonable for the services to be provided.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. The foregoing recitals are true and correct and are incorporated herein by reference.
SECTION 2. Based on a review of the entire record as a whole, the City Council hereby determines that the project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15323 (Normal Operations of Facilities for Public Gatherings), as the fireworks show is a recurring community event that does not represent a significant expansion of use beyond existing conditions.
SECTION 3. The City Council hereby awards a three-year Professional Services Agreement to Fireworks & Stage FX America, LLC for the production of the City’s annual Fourth of July fireworks show for the years 2026, 2027, and 2028 in a total contract amount not to exceed One Hundred Eighty-Five Thousand Dollars ($185,000).
SECTION 4. The City Council hereby authorizes and directs the City Manager to execute the Professional Services Agreement in a form substantially similar to that presented to the City Council on April 21, 2026.
SECTION 5. The City Council hereby authorizes and directs the City Manager and his designee(s) to execute such additional documents and take such other and further actions as are necessary and proper to accomplish the purposes of this resolution and implement the Fourth of July fireworks show for the years 2026, 2027, and 2028.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
