Re: Status of Special Event Permit Application, “San Clemente Festival of Freeride 2026” Dear Mr. Borruso:
We have received your application for a special event permit (“SEP”) to host a Jetski Freeriders event and competition North of the San Clemente Municipal Pier. After reviewing the application, Marine Safety has determined that the proposed event poses safety concerns due to the nature of the activity and conditions of our beach topography.
At this time, your special event permit is denied for the following reasons:
• No person shall launch any motorized watercraft from any public or private beach in the City unless such launching has been approved in writing by the Marine Safety Division of the City as part of a City-sanctioned event or the watercraft is an official public safety rescue vessel. No person shall operate any motorized, sail or paddle-powered watercraft within two hundred (200) feet of the San Clemente Municipal Pier unless such conduct is approved in writing by the Marine Safety Division of the City as part of a City-sanctioned event or the watercraft is an official public safety rescue vessel. (S.C.M.C. 12.32.040) • The requested site is not suitable for the intended organized activity. Sites must be able to accommodate the special event activity without impacting the general use of the site. (S.C.M.C. 12.34.020)
• The event will require the diversion of public safety or other City employees from their normal duties, so as to unreasonably reduce adequate levels of service or municipal functions to any other portion of the City. (S.C.M.C. 12.34.090) Please note that the applicant of a denied special event permit has the right to appeal the decision. The last date on which such an appeal may be filed shall be the third working day after the date on which the notice was delivered to the applicant. The City Council shall hear the applicant's appeal no later than 14 working days following its filing at a regular meeting, if scheduled, or a special meeting, if necessary. The applicant, by written request, may waive the time limits for the hearing on appeal to the City Council, but may not waive the time within which an appeal may be filed. The notice of the City Manager's decision on a permit for a spontaneous special event or the City Council's final decision on an appeal of a special event permit shall inform the applicant of his or her right to file a petition for writ of mandate pursuant to California Code of Civil Procedure Section 1094.6 or 1094.8. (S.C.M.C. 12.24.100) Thank you for your consideration and understanding.
Sincerely,
Alexandra Gallardo
