ORDINANCE NO. ---

AN ORDINANCE OF THE CITY OF SAN CLEMENTE, CALIFORNIA, SETTING MAYORAL TERM LIMITS WHEREAS, on November 7, 2023, the City Council of the City of San Clemente adopted Ordinance No. 1762, which, among other things, added Section 2.04.100 to Chapter 2.04 of Title 2 of the San Clemente Municipal Code, which provides in part that the elected Mayor “shall serve a term of two years, with a life-time term limit of three full terms, and without the ability to run for Mayor again after completing three full terms”; and WHEREAS, pursuant to Government Code section 36502(b), those term limits are not operative until submitted to the electors at a regularly scheduled election and a majority of the votes cast on the question favor the adoption of the limits.

NOW THEREFORE, THE PEOPLE OF THE CITY OF SAN CLEMENTE DO ORDAIN AS FOLLOWS:

SECTION 1. The provisions in Section 2.04.100 of Chapter 2.04 of Title 2 of the San Clemente Municipal Code, which provide that the elected Mayor “shall serve a term of two years, with a life-time term limit of three full terms, and without the ability to run for Mayor again after completing three full terms” shall be operative and are hereby enacted and approved.

SECTION 2. The City Council shall be prohibited from changing the terms limits for an elected Mayor as established by this Ordinance without a vote of the people. The term limits for an elected Mayor may be moved to a different Section in the Municipal Code for clarity or convenience provided that any such amendment does not change the substance of the fact that the elected Mayor shall serve a term of two years, with a life-time term limit of three full terms, and without the ability to run for Mayor again after completing three full terms.

SECTION 3. If any part of this Ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining parts of the ordinance. The City declares that it would have adopted this ordinance, and each part of it, irrespective of the possibility that some part or parts of it might be declared invalid or unconstitutional.

SECTION 4. This Ordinance shall take effect if it is approved by a majority of the eligible voters of the City of San Clemente voting at the General Municipal Election to be held on November 3, 2026, and shall only apply prospectively beginning with Mayor terms that start after the November 3, 2026 election. If so approved, the Ordinance becomes effective 10 days after the City Council declares and certifies the results of the election by resolution.

SECTION 5. The City Clerk/Elections Official is hereby directed to publish this Ordinance at least once, within 15 days after the election results are certified, in a newspaper of general circulation published and circulated in the City of San Clemente.

I certify that Ordinance No. --- was adopted by the electorate of the City of San Clemente at a General Municipal Election held on November 3, 2026. This Ordinance was adopted as a result of the passage of Measure ___. Please refer to Resolution No. ____ for the recitation of the election results. ______________________________
