RESOLUTION NO. 26-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONCESSION AGREEMENT TO HOOK AND COOK SC, LLC FOR THE OPERATION OF THE END-OF-PIER BAIT & TACKLE, FOOD, AND NON-ALCOHOLIC BEVERAGE CONCESSION AT THE SAN CLEMENTE MUNICIPAL PIER WHEREAS, the City of San Clemente (“City”) owns and operates the San Clemente Municipal Pier, a valued public amenity serving residents and visitors; and WHEREAS, the end-of-pier concession facility provides an important service to the public by offering bait and tackle sales and food and beverage amenities; and WHEREAS, the City released a Request for Proposals (RFP) to solicit qualified operators for the concession and received nine (9) responsive proposals; and WHEREAS, staff conducted a competitive evaluation process, including proposal review and interviews with all responsive proposers, based on criteria including experience, business concept, financial proposal, and operational approach; and WHEREAS, Hook and Cook SC, LLC is the most qualified proposer and offers the best overall value to the City and the compensation is fair and reasonable; and WHEREAS, Hook and Cook SC, LLC proposes to operate the concession under the business name “Hook & Cook,” providing a balanced offering of bait and tackle services and food and non-alcoholic beverages while enhancing the visitor experience at the pier; and WHEREAS, the proposed Concession Agreement establishes a four (4) year initial term with one (1) optional two (2) year extension, and provides for compensation to the City in the form of a base monthly rent or a percentage of gross sales, whichever is greater; and WHEREAS, the Concession Agreement is in the best interest of the City and the public.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. The City Council hereby finds that the facts set forth in the recitals above are true and correct and are incorporated fully herein by this reference.
SECTION 2. Based on a review of the record as a whole, the City Council hereby finds and determines that the project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 of the CEQA Guidelines, Section 15301 (14 CCR 15301, Existing Facilities), as it consists of the continued operation of an existing public facility.
SECTION 3. The City Council hereby awards a Concession Agreement to Hook and Cook SC, LLC for the operation of the end-of-pier bait and tackle, food, and non-alcoholic beverage concession for a four-year term with one two-year extension option.
SECTION 4. The City Council hereby authorizes and directs the City Manager, or his designee, to execute the Concession Agreement in a form substantially similar to that presented to the City Council on May 5, 2025.
SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
