RESOLUTION NO. 26-88
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING AN EXEMPTION TO THE FORMAL SOLICITATION PROCESS, AWARDING A PROFESSIONAL CONSULTANT SERVICES AGREEMENT TO AKM CONSULTING ENGINEERS FOR ENGINEERING CONSTRUCTION SUPPORT SERVICES DURING CONSTRUCTION OF THE REEVES BOOSTER PUMP STATION, CIP PROJECT NO. 17405, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE PROFESSIONAL CONSULTANT SERVICES AGREEMENT, IN AN AMOUNT NOT TO EXCEED $183,048 WHEREAS, the City of San Clemente Water Master Plan, dated March 2006, recommended construction of the Reeves Booster Pump Station to supply potable water from a regional water main trunk (Local Transmission Main) to Forester Ranch and Marblehead areas; and WHEREAS, the proposed Reeves Booster Pump Station will convey water to the Reservoir 7 zone and provide an alternate supply source, which improves system reliability; and WHEREAS, the project requires Engineering Construction Support Services. The scope of work includes responding to requests for information from the contractor (RFI’s), reviewing submitted documentation, conducting site visits, commissioning, observations, and preparing record drawings during the construction of the Reeves Booster Pump Station; and WHEREAS, AKM is the Engineer of Record for the Reeves Pump Station design and the preparer of the plans and specifications for the project; and WHEREAS, the Engineer of Record needs to provide construction support services during construction, ensuring their professional design is integrated into the work being performed by the contractor in the field; and WHEREAS, City Purchasing Policy 201-2-1 Section XI.A.1.2 permits the City Council to authorize an exemption to the formal solicitation process when the City Council determines that compliance with the formal process would be inefficient, impractical, or not in the best interest of the City based on specifically identified conditions and supported by substantial evidence in the record; and WHEREAS, staff requested and received a proposal from AKM for the engineering construction support services for the project, in the amount of $183,048; and WHEREAS, AKM Consulting Engineers’ fee is fair and reasonable.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That an exemption to the formal solicitation process in accordance with the City Purchasing Policy 201-2-1, Section XI.A.1.2. is hereby approved because compliance with the formal process would be inefficient, impractical, or not in the best interest of the City based on the fact that AKM Consulting Engineers is the Engineer of Record for the project and awarding construction support services for the project to another firm would require redesigning the project and changing the Engineer of Record.
SECTION 3. A Professional Consultant Services Agreement is hereby awarded to AKM Consulting Engineers for Engineering Construction Support Services for the Reeves Booster Pump Station, CIP Project No. 17405.
SECTION 4. That the City Manager is authorized and directed to execute a Professional Services Agreement with AKM Consulting Engineers in an amount not to exceed $183,048, in a form substantially similar to that presented to the City Council on May 5, 2026, for the Reeves Booster Pump Station, CIP Project No. 17405.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
