Reeves Booster Pump Station Bid Protest for Elegant Construction Inc Subject: Protest for Elegant Construction Inc
After a Review of the Bid Documents submitted by Elegant Construction Inc we have identified a few items Experience:
Elegant Construction Inc listed experience of jobs for Park Renovation, Pools, Restrooms, Parking lots, and a locker room. None of those projects specify a pump/booster station. As specified, that "contractor must specify a minimum of 5 similar completed projects." It is our opinion that the jobs listed are not similar to the scope of a booster pump station
Subcontractors:
Elegant Construction Inc failed to list a Masonry subcontractor, Roofing Subcontractor, and Shoring Subcontractor.
Listed subcontractors only include Electrical, Roll Up Door, and Pump Installation. Per subcontracting law all subcontractor more than 0.5% of the bid or more than $10,000 must be listed in the bid documents. Based on the experience listed previously Elegant Construction Inc has not shown that they have the experience of doing the Masonry wall for the building or the Clay Tile Roofing
Furthermore, regarding the listed electrical contractor Nexro Energy Inc when looking up the CSLB contractor License number 1137110 the contractor license was issued less than 1 year ago on 5/6/2025 and workers compensation becoming effective on 11/26/25. This would mean that Nexro Energy Inc has only been performing electrical work at most 4 months.
Signatures on Bid Docs:
On Pages 5, 7, 13, 19, 23, 24, and 25 of the bid documents Elegant Construction Inc electronically signed on all pages for Hazem Almassry. Per California DGS Policy 1240-AUG-2018 All parties must agree or consent to conduct the transaction electronically. The signature must also be capable of verification to confirm the validity of who electronically signed the document.
Attachment 4
For these reasons RE Chaffee believes that Elegant Construction Inc should be found non-responsive and the contract should go to the next responsible bidder.
