RESOLUTION NO. 26-100
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A SECOND AMENDMENT TO THE AGREEMENT FOR CERTIFIED FARMERS MARKET OPERATOR SERVICES TO EXTEND THE AGREEMENT TERM THROUGH SEPTEMBER 30, 2026, AND FINDING THE ACTION CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 OF THE STATE CEQA GUIDELINES (EXISTING FACILITIES, 14 CCR 15301) WHEREAS, the City of San Clemente (“City”) currently maintains an agreement for the operation and management of the City’s Certified Farmers Market located on Avenida Del Mar (“Agreement”); and WHEREAS, the City recently initiated a Request for Proposals (RFP) process seeking qualified operators for the future long-term operation and management of the Certified Farmers Market; and WHEREAS, staff is currently evaluating proposals, conducting additional due diligence, and may conduct interviews with qualified proposers prior to returning to the City Council with a recommendation for a long-term agreement; and WHEREAS, the current Agreement is scheduled to expire prior to completion of the evaluation and negotiation process; and WHEREAS, the City Council finds that extending the current Areement through September 30, 2026 will support continuity of operations during the peak summer season, avoid disruption to market customers, vendors, downtown businesses, and overall market operations while the City completes its evaluation process and is in the best interests of the City and the public.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. The foregoing recitals are true and correct and are fully incorporated herein by this reference.

SECTION 2. Based on a review of the record as a whole, the City Council hereby determines that the proposed action is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 of the state CEQA Guidelines (Existing Facilities, 14 CCR 15301) because it consists of continuing the current farmers market operations in the same location with negligible or no expansion of the existing use.

SECTION 3. The City Council hereby approves extending the Agreement term through September 30, 2026.

SECTION 4. The City Council hereby authorizes and directs the City Manager to execute a Second Amendment to the Agreement for Sunday Farmers Market in a form substantially similar to the presented to the City Council on June 2, 2026.

SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
