RESOLUTION NO. 26-117
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, TO ACCEPT AND FILE A NOTICE OF COMPLETION FOR THE CONSTRUCTION CONTRACT WITH ALLIANCE DIVERSIFIED ENTERPRISES, INC. FOR THE MARQUITA SLOPE INTERIM RECONSTRUCT, CIP PROJECT NO. 21208, AND UNENCUMBER CERTAIN FUNDS WHEREAS, in order to protect public health and safety, repairs were needed immediately to secure the Linda Lane Pump Station to protect life and property prior to the 2025 winter rain season; and WHEREAS, on August 11, 2025, the City Council awarded a construction contract to Alliance Diversified Enterprises, Inc. for the Marquita Slope Interim Reconstruct CIP Project No. 21208; and WHEREAS, the project consisted of installing caissons and tiebacks, re-grading the slope with geogrid, and removing an existing soldier-pile wall at the toe of the slope; and WHEREAS, Alliance Diversified Enterprises, Inc. has completed the work to the satisfaction of the Public Works Director/City Engineer; and WHEREAS, the total project construction cost of $2,934,552 was within the approved project budget of $3,682,400, funded by the Sewer Fund Depreciation Reserve, Account No. 054-476-45300-000-21208; and WHEREAS, the remaining balance of the work to be performed on this project is estimated at approximately $292,848, which is needed to remain in the project account for future landscaping and permitting work related to the Coastal Development Permit, which is currently under review by the Coastal Coastal Commission.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. That the City Council accepts as complete the construction work under the contract with Alliance Diversified Enterprises, Inc., for the Marquita Slope Interim Reconstruct, CIP Project No. 21208.
SECTION 3. That the City Clerk is authorized and directed to execute and record the Notice of Completion for the construction work under the contract with Alliance Diversified Enterprises, Inc. for the Marquita Slope Interim Reconstruct CIP Project No. 21208.
SECTION 4. That the City Council approves and authorized unencumbering the amount of $455,000 from the project Account No. 054-476-45300-000-21208 to return back to the Sewer Fund Depreciation Reserve, Account No. 054-476-45000.
SECTION 5. That the City Clerk is authorized and directed to release the Payment Bond 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, Alliance Diversified Enterprises, Inc.
SECTION 6. That the City Clerk is authorized and directed to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director in the amount of 25% of the total construction cost.
SECTION 7. That City staff is hereby authorized and directed to take such other and further actions as are necessary and proper to close out the project and accomplish the purposes of this resolution.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
