Resolution no. 26-126
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE IN SUPPORT OF MODIFICATIONS TO STATE GAS TAX AND SB-1 ROAD MAINTENANCE AND REHABILITATION ACCOUNT (RMRA) FUNDING ALLOCATIONS TO ORANGE COUNTY CITIES WHEREAS, the City of San Clemente receives State Gas Tax revenue from several different funds including: State Gas Tax Funds 2103, 2105, 2106, 2107, and 2107.5; and WHEREAS, the Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes the Road Maintenance and Rehabilitation Account (RMRA) funding to the City of San Clemente; and WHEREAS, each fund has different funding formulas, but the distribution of funding to each jurisdiction is generally based on several different factors, such as population, number of registered vehicles, and miles of public streets; and WHEREAS, the funding formulas currently result in the County of Orange receiving a larger share of funding (43%), while the County is only responsible for maintenance of 6% of the streets in the County; and WHEREAS, the County has responded to the matter and is proposing a new competitive County grant program called the Orange County Road Maintenance Assistance Program (OC RoadMAP); and WHEREAS, the OC RoadMAP grant would allocate $5,000,000 from the County’s allotted funds to 5-10 city projects within the County that qualify for the competitive grant; and WHEREAS, many cities in the County are asking the County to eliminate this new competitive grant and instead reformulate the overall funding allotments for the County and cities so that allocations better align with maintenance responsibilities.

NOW, THEREFORE, IT IS HEREBY RESOLVED, ORDERED, AND FOUND by the City Council of the City of San Clemente, State of California, as follows:

SECTION 1: Incorporation of Recitals.

The City Council hereby finds that all of the facts in the Recitals above are true and correct and are incorporated and adopted as fully set forth in this resolution.
