RESOLUTION NO. 26-115
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, FILING A NOTICE OF COMPLETION, AND ACCEPTING AS COMPLETE THE PICO / PRESIDIO DIP REPLACEMENT PHASE II, CIP PROJECT NO. 13411 WHEREAS, the waterline located at the Gateway Village Plaza adjacent to the intersection of Avenida Pico and Avenida Presidio was found to be at the end of its useful life and in need of replacement; and WHEREAS, on December 9, 2025, the City Council awarded a construction contract to Big Ben, Inc. for the Pico / Presidio DIP Replacement Phase II, CIP Project No. 13411; and WHEREAS, the project consisted of the abandonment of the existing waterline, concrete repair, asphalt repair, and the construction and connection of a new waterline and appurtenances to replace the existing system; and WHEREAS, Big Ben, Inc. has completed the work to the satisfaction of the Public Works Director/City Engineer.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated herein.
SECTION 2. That the City Council accepts as complete the Pico / Presidio DIP Replacement Phase II, CIP Project No. 13411, from Big Ben, Inc.
SECTION 3. That the City Clerk is authorized and directed to execute and record the Notice of Completion for the Pico / Presidio DIP Replacement Phase II, CIP Project No. 13411.
SECTION 4. That the City Clerk is authorized and directed to release the Payment Bond 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against the Contractor, Big Ben, Inc.
SECTION 5. That the City Clerk is authorized and directed to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director in the amount of 25% of the total construction cost.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
