RESOLUTION NO. 26-116
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, FILING A NOTICE OF COMPLETION, AND ACCEPTING AS COMPLETE THE ALLEY PAVEMENT REHABILITATION PROGRAM, CIP PROJECT NOS. 16316, 15316, AND 12305 WHEREAS, on February 17, 2026, the City Council awarded a construction contract to Eagle Paving LLC for the Alley Pavement Rehabilitation Program, CIP Project Nos. 16316, 15316, and 12305; and WHEREAS, the work consisted of repairing asphalt pavement and constructing four feet wide concrete alley gutter at the 100 block of Avenida Del Mar alley to improve drainage; and WHEREAS, Eagle Paving LLC has completed the work to the satisfaction of the Public Works Director/City Engineer.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the City Council accepts as complete the Alley Pavement Rehabilitation Program, CIP Project Nos. 16316, 15316, and 12305 from Eagle Paving LLC.
SECTION 3. That the City Council authorizes the City Clerk to execute and record a Notice of Completion for the Alley Pavement Rehabilitation Program, CIP Project Nos. 16316, 15316, and 12305.
SECTION 4. That the City Council authorizes the City Clerk to release the payment bond for this project 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against Eagle Paving LLC.
SECTION 5. That the City Council authorizes the City Clerk to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director/City Engineer in the amount of 25% of the total construction cost.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
