RESOLUTION NO. 26-121
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING A THIRD AMENDMENT TO THE AGREEMENT FOR MAINTENANCE SERVICES FOR STREET SWEEPING WITH SCA OF CA, LLC, AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM CEQA UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR 15301) OF THE STATE CEQA GUIDELINES SECTION 15301 WHEREAS, the City of San Clemente ("City") entered into an Agreement for Maintenance Services for Street Sweeping on May 18, 2021, with Cannon Pacific Services, Inc. dba Pacific Sweeping for citywide street sweeping services; and WHEREAS, SCA of CA, LLC subsequently acquired Cannon Pacific Services, Inc. and assumed all rights and obligations under the Agreement; and WHEREAS, the City Council previously approved two contract amendments extending the Agreement to provide street sweeping services through June 30, 2026; and WHEREAS, street sweeping is an important municipal service that supports roadway maintenance, neighborhood appearance, and stormwater quality objectives by removing debris and pollutants from public streets before they enter the City's storm drain system and local waterways; and WHEREAS, the City is currently evaluating long-term service delivery alternatives for street sweeping services, including continuation of contracted services, transitioning operations in-house, modifications to service levels, and other operational alternatives; and WHEREAS, staff anticipates returning to the City Council in Fall 2026 with a comprehensive evaluation of street sweeping service delivery options, including operational, financial, staffing, equipment, and implementation considerations; and WHEREAS, approval of a month-to-month continuation of the existing Agreement will ensure uninterrupted street sweeping services while preserving flexibility for future City Council direction and is in the best interests of the City and the public.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:

SECTION 1. The foregoing recitals are true and correct and fully incorporated herein as findings.

SECTION 2. Based on a review of the record as a whole, the City Council hereby finds and determines that this project is categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR 15301) of the state CEQA Guidelines section 15301 because, as street sweeping, it consists of maintenance of existing public facilities with negligible or no expansion of existing or former use.

SECTION 3. The City Council hereby approves a Third Amendment to the Agreement for Maintenance Services for Street Sweeping with SCA of CA, LLC to extend the Agreement, as previously amended, on a month-to-month basis beginning July 1, 2026 and extending up to a maximum of fourteen (14) months, with total annual compensation not to exceed $619,072.29, and implementing a 3.5 percent consumer price index adjustment.

SECTION 4. The City Manager is hereby authorized and directed to execute such Third Amendment in substantially the same form as presented to the City Council on June 16, 2026.

SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
