RESOLUTION NO. 26-112
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, ACCEPTING AS COMPLETE THE EMERGENCY SLOPE STABILIZATION REPAIRS AT CASA ROMANTICA, CIP PROJECT NO. 23502, APPROVING SUPPLEMENTAL APPROPRIATIONS IN THE AMOUNT OF $3,370,602 TO ACCOUNT NUMBER 001-481-43470-000-23502 AND AUTHORIZING THE CITY MANAGER TO APPROVE A CONTRACT AMENDMENT FOR ADDITIONAL WORK IN THE AMOUNT OF $3,310,602 WHEREAS, on August 15, 2023, the City Council awarded a construction contract to Alliance Diversified Enterprises, Inc. for the Emergency Slope Stabilization Repairs at Casa Romantica, CIP Project No. 23502; and WHEREAS, the initial scope of work repairing a landslide at 415 Avenida Granada, included tie-back design, installation of four (4) rows of grade beams and tiebacks, grading, and installing geogrid reinforcement; and WHEREAS, additional work was completed at the City’s request on an emergency basis due to several unknown conditions, including: dewatering to address persistent groundwater seepage along the slope face, large cavities requiring significantly more grout than anticipated, additional shotcrete due to caving around installed grade beams, expanded work limits to the south to locate competent material, an expanded lower keyway, temporary visqueen to cover the slope during rain events, storm drain lines, headwalls, riprap, sewer manholes and sewer lines; and WHEREAS, Alliance Diversified, Enterprises, Inc. has completed the work to the satisfaction of the Public Works Director/City Engineer.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the City Council authorizes the transfer of $452,000 from the Sewer Unrestricted Fund Balance 054-000-23330 to General Fund to increase the budget for account number 001-481-43470-23502.
SECTION 3. That the City Council authorizes the transfer of $2,918,602 from the Reserve Unrestricted Fund Balance 014-000-23430 transferred to General Fund to increase the budget for account number 001-481-43470-000-23502.
SECTION 4. That the City Council authorizes and directs the City Manager to execute an amendment to the construction contract with Alliance Diversified Enterprises, Inc. for the Emergency Slope Stabilization Repairs at Casa Romantica, CIP Project No. 23502, for the additional work completed by Alliance Diversified Enterprises, Inc. in the amount of $3,310,602 together with such additional contract documents as are necessary and proper to implement such amendment, including, but not limited to, a general mutual release of all claims.
SECTION 5. That the City Council accepts as complete the Emergency Slope Stabilization Repairs at Casa Romantica, CIP Project No. 23502, from Alliance Diversified, Enterprises, Inc.
SECTION 6. That the City Council authorizes and directs the City Clerk to execute and record a Notice of Completion for CIP Project No. 23502.
SECTION 7. That the City Council authorizes and directs City staff to take such other and further actions as are necessary and proper to close out the Emergency Slope Stabilization Repairs at Casa Romantica, CIP Project No. 23502, and accomplish the purposes of this resolution.
SECTION 8. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
