Public Works Director/ City Engineer
Subject: Formal Protest of Recommended Award to Union Pavement Services, Inc. - FY 2026 Street Rehabilitation Program, Project No. 16325
Dear Mayor, Members of the City Council, Mr. Rebensdort: and City Staff:

Pavement Coatings Co. ("PCC") hereby formally protests the recommendation to award the FY 2026 Street Rehabilitation Program, Project No. 16325, to Union Pavement Services, Inc.

PCC respectfully requests that the City Council reject the recommendation to deem PCC's bid nonresponsive and instead determine that PCC submitted a responsive and responsible bid and is the lowest responsive and responsible bidder eligible for award.

BACKGROUND
On April 23. 2026, bids were opened for the Project. The bid results were as follows:

Bidder Bid Amount
All American Asphalt $942,731.54
Pavement Coatings Co. $949,922.79
Union Pavement Services $956,950.52
PCC was the apparent second-low bidder, only $7,191.25 higher than the apparent low bidder and $7,027.73 lower than Union Pavement Services.

Following bid opening, Union Pavement Services filed a protest alleging that both All American Asphalt and Pavement Coatings Co. should be deemed nonresponsive pursuant to Section 18 of the Instructions to Bidders, entitled "Disqualification of Bidders; Interest in More Than One Bid."
