RESOLUTION NO. 26-129
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A MAINTENANCE SERVICES CONTRACT TO BPR, INC. FOR PROFESSIONAL SIDEWALK TRIP HAZARD REMOVAL AND ASSESSMENT SERVICES, CIP PROJECT NO. 27311 IN AN AMOUNT NOT TO EXCEED $220,000, AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR SECTION 15301) OF THE STATE CEQA GUIDELINES WHEREAS, sidewalk repair and maintenance services are needed to address sidewalk trip hazards throughout the City of San Clemente; and WHEREAS, staff prepared a request for proposals for the Sidewalk Repair and Maintenance Services, Project No. 27311 (Maintenance Services) in compliance with Section IX of the City’s Procurement Policy and Procedure on the Selection of General Service Consultants and Contractors; and WHEREAS, on May 7, 2026, the City received four proposals from BPR, Inc., Universal Concrete Grinding, LLC, and Southern California Precision Concrete, Inc. dba Precision Concrete Cutting, and Greek Concrete, Inc.; and WHEREAS, the proposal submitted by Greek Concrete, Inc. was non-responsive; and WHEREAS, staff carefully evaluated and reviewed four submissions and determined that BPR, Inc. is the most qualified and competent sidewalk maintenance services contractor and their fee is fair and reasonable.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. That based upon substantial evidence in the record as a whole, the Project is hereby determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the State CEQA Guidelines because it consists of maintenance of existing City facilities, involves negligible or no expansion of existing or former use and there is no possibility of a direct or reasonably foreseeable indirect effect on the environment.
SECTION 3. That the Maintenance Services Contract Agreement for the Sidewalk Repair and Maintenance Services, Project No. 27311, is hereby awarded to BPR, Inc.
SECTION 4. That the City Manager is authorized and directed to execute a maintenance services contract for the Sidewalk Repair and Maintenance Services, Project No. 27311, with BPR, Inc. in an amount not to exceed $220,000 in a form substantially similar to that presented to City Council on August 4, 2026.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
