RESOLUTION NO. 26-140
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A CONSTRUCTION CONTRACT TO JUDGE NETTING, INC. FOR DRIVING RANGE ERRANT BALL NETTING EXTENSION, CIP PROJECT NO. 13607, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONSTRUCTION CONTRACT WITH JUDGE NETTING, INC. IN THE AMOUNT OF $313,200, AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) UNDER SECTION 15301 (CLASS 1), AND SECTION 15302 (CLASS 2) OF THE STATE CEQA GUIDELINES WHEREAS, the existing western portion of the Municipal Golf Course Driving Range Net can be raised, which will reduce the number of errant golf balls entering to and from the sixth hole and the driving range; and WHEREAS, an expansion of the Driving Range Errant Ball Netting will improve safety measures and enhance golf patrons overall experience on the golf course; and WHEREAS, on August 28, 2025, the Golf Course Committee reviewed the proposed changes to the height of the errant ball netting located on the west side (sixth hole) of the driving range and provided a recommendation to the City Council for approval; and WHEREAS, the project involves replacing the existing 30-foot steel poles with fully engineered wooden poles standing 70 feet above the ground and attaching 10-foot steel extensions to the four wooden poles on the southwest side of the driving range; and WHEREAS, on April 17, 2026, the City received two bids for the Project ranging from $230,000 to $310,700 for Base Bid, and $234,500 to $313,200 for Base Bid plus Alternate Bid for the Project; and WHEREAS, the apparent low Base Bid of $230,000 was received from West Coast Netting, Inc. of Kingman, Arizona; and WHEREAS, West Coast Netting, Inc. failed to fulfill the bid submission requirements.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. That the above recitations are true and correct and fully incorporated herein.
SECTION 2. Based on a review of the record as a whole, that the Driving Range Errant Ball Netting Extension, CIP Project No. 13607, is hereby determined to be categorically exempt from the California Environmental Quality Act (CEQA) under Section 15301, Class 1 (Existing Facilities) and Section 15302, Class 2 (Replacement or Reconstruction) of the state CEQA Guideline because the project consists of the alteration of existing public structures or facilities; involves negligible or no expansion of existing or former use; and presents no potential to cause a significant effect on the environment, whether direct or reasonably foreseeable indirect in nature.
SECTION 3. That the City Council insists on strict compliance with the bid specifications and rejects West Coast Netting, Inc.’s bid as defective and non-responsive.
SECTION 4. That the construction contract for the Driving Range Errant Ball Netting Extension, CIP Project No. 13607, is hereby awarded to Judge Netting, Inc. as the lowest responsive and responsible bidder, based on the “Base Bid.” SECTION 5. That the City Manager is hereby authorized and directed to execute a construction contract with Judge Netting, Inc. in the amount of $313,200 for the Driving Range Errant Ball Netting Extension, CIP Project No. 13607, in a form substantially similar to that presented to the City Council on August 18, 2026.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
