RESOLUTION NO. 26-137
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, FILING A NOTICE OF COMPLETION, AND ACCEPTING AS COMPLETE THE FY 2026 MAJOR STREET MAINTENANCE AND FY 2026 PAVEMENT PRESERVATION PROGRAM, CIP PROJECT NOS. 26303 AND 26304 WHEREAS, on February 3, 2026, the City Council awarded a construction contract to L.C. Paving & Sealing, Inc. for the FY 2026 Major Street Maintenance and FY 2026 Pavement Preservation Program, CIP Project Nos. 26303 and 26304; and WHEREAS, the work consisted of grinding and repaving deteriorated pavement, removing and replacing curb and gutter, sidewalk, curb ramps, driveway approaches, and manhole cover and water valve can adjustments on various streets throughout the City; and WHEREAS, L.C. Paving & Sealing, Inc. has completed the work to the satisfaction of the Public Works Director/City Engineer.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the City Council accepts as complete the FY 2026 Major Street Maintenance and FY 2026 Pavement Preservation Program, CIP Project Nos. 26303 and 26304 from L.C. Paving & Sealing, Inc.
SECTION 3. That the City Council authorizes the City Clerk to execute and record a Notice of Completion for the FY 2026 Major Street Maintenance and FY 2026 Pavement Preservation Program, CIP Project Nos. 26303 and 26304.
SECTION 4. That the City Council authorizes the City Clerk to release the payment bond for this project 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against L.C. Paving & Sealing, Inc.
SECTION 5. That the City Council authorizes the City Clerk to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director/City Engineer in the amount of 25% of the total construction cost.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
