RESOLUTION NO. 26-138
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, TO ACCEPT AND FILE A NOTICE OF COMPLETION FOR THE CONSTRUCTION CONTRACT WITH GCI CONSTRUCTION FOR THE RESERVOIR 12 SITE IMPROVEMENT, CIP PROJECT NO. 23403 WHEREAS, on March 17, 2026, the City Council awarded a construction contract to GCI Construction, Inc. for the Reservoir 12 Site Improvements, CIP Project No. 23403; and WHEREAS, the project consisted of installing 201 linear feet of two 8-inch PVC drain pipes, asphalt concrete, 115 linear feet of retaining concrete curb, and a 12-inch square drainage inlet; and WHEREAS, GCI Construction, Inc. has completed the work to the satisfaction of the Public Works Director/City Engineer; and WHEREAS, the total project construction costs of $160,658 was within the approved project budget of $200,000, funded by the Water Fund Depreciation Reserve, Account No. 052-466-43420-000-23403.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. That the City Council accepts as complete the Reservoir 12 Site Improvement, CIP Project No. 23403 from GCI Construction, Inc.
SECTION 3. That the City Council authorizes the City Clerk to execute and record a Notice of Completion for Reservoir 12 Site Improvements, CIP Project No. 23403.
SECTION 4. That the City Council authorizes the City Clerk to release the payment bond for this project 35 days from the recordation of the Notice of Completion upon verification with the Engineering Division that no liens have been levied against GCI Construction, Inc.
SECTION 5. That the City Council authorizes the City Clerk to release the performance bond for this project upon receipt of a warranty bond in a form acceptable to the Public Works Director/City Engineer in the amount of 25% of the total construction cost.
SECTION 6. That City staff is hereby authorized and directed to take such other and further actions as are necessary and proper to close out the project and accomplish the purposes of this resolution.
SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
