RESOLUTION NO. 26-141
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AUTHORIZING AN EXEMPTION TO THE FORMAL SOLICIATION PROCESS, AWARDING A CONTRACT TO ACE PARKING III, LLC FOR PARKING ENFORCEMENT SERVICES FOR PHASE 2 OF THE CITY’S PARKING ENFORCEMENT PILOT PROGRAM, AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WHEREAS, the City of San Clemente provides parking enforcement services throughout the community to support compliance with parking regulations, safety, improve parking availability, and promote turnover of limited parking resources, particularly in high-demand areas such as the downtown area; and WHEREAS, the City’s Retired Senior Volunteer Program (RSVP) provides valuable parking enforcement services and community engagement; however, because RSVP relies on volunteer staffing, enforcement coverage is limited by volunteer availability and scheduling constraints; and WHEREAS, pursuant to the City Manager’s existing contract authority, the City entered into an initial five-month agreement with Ace Parking, effective March 18, 2026 through August 22, 2026, during which Ace Parking provided supplemental parking enforcement services and collected operational data to aid staff in evaluating parking management needs and identifying opportunities to improve parking management; and WHEREAS, staff has identified the continued need for supplemental enforcement services to complement RSVP, improve parking compliance and turnover, particularly in high-demand parking areas, and provide data to support City staff’s evaluation of parking enforcement and parking management improvements during Phase 2 of the City’s parking enforcement pilot program; and WHEREAS, the City desires to continue supplemental parking enforcement services with Ace Parking through a six-month Professional Services Agreement to maintain operational continuity, provide additional enforcement resources during periods of increased demand, and continue collecting information through Phase 2; and WHEREAS, Section XI.A.1.2 of the City’s Procurement Policy No. 201-2-1 authorizes an exemption from the formal solicitation process when the City Council determines by minute action or resolution, that compliance with the bidding requirements and procedures is inefficient, impractical, or not in the best interest of the City, based on specifically identified conditions and supported by substantial evidence in the record; and WHEREAS, utilizing Ace Parking for continued supplemental parking enforcement services is in the best interest of the City because it provides continuity of service, supports improved parking compliance and turnover, complements the City’s RSVP program, allows the City to continue gathering operational data necessary to inform future parking management decisions and is more efficient and practical for Phase 2; and WHEREAS, compliance with formal bidding requirements and procedures at this time would be inefficient, impractical, and not in the best interest of the City due to the need to maintain continuity of parking enforcement services during Phase 2 while the City evaluates future parking management and procurement needs.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine and resolve as follows:
SECTION 1. The City Council hereby finds that the recitals above are true and correct and are incorporated fully herein by reference.
SECTION 2. Pursuant to Section XI. A. 1.2 of City Procurement Policy No. 201-2-1, the City Council hereby authorizes an exemption from the formal solicitation process for supplemental parking enforcement services for Phase 2 of the City’s parking enforcement pilot program because, based on substantial evidence in the record, the City Council finds and determines that compliance with the bidding requirements and procedures is inefficient, impractical, or not in the best interest of the City.
SECTION 3. The City Council hereby awards a Professional Services Agreement to Ace Parking III, LLC for supplemental parking enforcement services during Phase 2 of the parking enforcement pilot program for an initial six-month term from August 23, 2026, through February 22, 2027, in an amount not to exceed $89,700. The City Council further authorizes the City Manager, at their discretion, to extend the Agreement on a month-to-month basis following the initial term, at an amount not to exceed $14,950 per month, for a period not to exceed six additional months, subject to available appropriations.
SECTION 4. The City Council hereby authorizes and directs the City Manager to execute a Professional Services Agreement for parking enforcement services for Phase 2 of the parking enforcement pilot program in a form substantially similar to that presented to City Council on August 18, 2026.
SECTION 5. City staff are authorized and directed to take all other and further actions as are necessary and proper to carry out the intent of this Resolution, implement the Agreement and move forward with Phase 2 of the parking enforcement pilot program.
SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
PASSED AND ADOPTED this _____ day of August 18, 2026.
