WHEREAS, the Legislature of the State of California has established the State Coastal Conservancy (“Conservancy”) under Division 21 of the California Public Resources Code, and has authorized the Conservancy to award grants to public agencies and nonprofit organizations to implement the provisions of Division 21; and WHEREAS, the Conservancy awards grants for projects that it determines are consistent with Division 21 of the Public Resources Code and with the Conservancy’s Strategic Plan and that best achieve the Conservancy’s statutory objectives, in light of limited funding; and WHEREAS, at its April 23, 2026 meeting, the Conservancy adopted a resolution authorizing a grant to the City of San Clemente (“grantee”) for the North Beach Sand Retention Planning Project (“the Project”), which is the second planning and study phase and continues the work from phase one. The resolution was adopted by the Conservancy pursuant to and is included in the Conservancy April 23, 2026 staff recommendation, a copy of which is on file with the grantee and with the Conservancy; and WHEREAS, the State Coastal Conservancy will disburse up to $2,000,000 to the City of San Clemente for the Project, consisting of preparing technical studies, an alternatives analysis, preliminary designs, and conducting community engagement for a sand retention project to address coastal erosion along the San Clemente shoreline, in Orange County; and WHEREAS, the Conservancy requires that the governing body of the grantee certify through a resolution that it approves the award of Conservancy grant funding and authorizes the execution by a representative of the grantee of a grant agreement on terms and conditions required by the Conservancy grant agreement number 26-001.

NOW THEREFORE, the City Council of the City of San Clemente, California, does hereby find, determine, and resolve as follows:

SECTION 1. That the foregoing recitations are true, correct, and fully incorporated herein.

That, based on a review of the record as a whole, it is hereby determined that the Project is statutorily exempt from California Environmental Quality Act (CEQA) under section 15262 (Feasibility and Planning Studies) and categorically exempt from the California Environmental Quality Act (CEQA) under Class 6, Section 15306 of the state CEQA Guidelines (14 CCR 15306 – Information Collection) because the study will not have a legally binding effect on later activities and because the study consists of basic data collection, research, and resource evaluation activities that do not result in a serious or major disturbance to an environmental resource.

SECTION 3. That the grant funding from the Conservancy for the Project in the amount of $2,000,000 is hereby accepted and approved for receipt into miscellaneous grant revenue account number 014-636-45300-000-17700.

SECTION 4. That City staff is authorized and directed to make a related budget appropriation of $2,000,000 to account number 014-636-45300-000-17700 and take such other and further actions as are necessary to properly account for the funds.

SECTION 5. That the City has or will have sufficient funds to complete the current phase of the Project.
