A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AN EXEMPTION TO THE CITY’S PURCHASING POLICIES AND PROCEDURES APPROVING THE 2026 WATER LOSS CONTROL AGREEMENT BETWEEN THE CITY OF SAN CLEMENTE AND THE MUNICIPAL WATER DISTRICT OF ORANGE COUNTY AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT WHEREAS, The City contracts with the Municipal Water District of Orange County (MWDOC) under the 2026 Water Loss Control Agreement (Agreement) for technical services required to complete the City’s annual Water Loss Audit; and WHEREAS, The City and MWDOC seek to extend the term of the Agreement that went into effect July 1, 2016 and expires June 30, 2026; and WHEREAS, the approval of the Agreement will extend the term from July 1, 2026 through June 30, 2036; and WHEREAS, the extension of the Agreement will allow the city to continue to participate in MWDOC’s Water Loss Control Program through June 30, 2036; and WHEREAS, Section XI.A.1.1.5 of Procurement Policy and Procedure No. 201-2-1 (Purchasing Policies and Procedures) allows the City Council to authorize an exemption to the formal and informal solicitation process for “Services and/or supplies obtained from or through agreement with any governmental, public or quasi-public entity”; and WHEREAS, the Water Loss Control Program is one of the essential tools that will help the city reach its compliance goals under the AB606/SB1668 regulatory framework for water conservation and water use efficiency.

NOW, THEREFORE, The City Council of the City of San Clemente does hereby resolve as follows:

SECTION 1. That the above recitals are true and correct and incorporated herein by reference.

SECTION 2. That the 2026 Water Loss Control Agreement will extend the Agreement for an additional 10 years from July 1, 2026 through June 30, 2036.

SECTION 3. That the approval of the Agreement will allow the City to continue to participate in the MWDOC’s Water Loss Control Program through June 30, 2036.

SECTION 4. That the City Council authorizes an exemption to the formal and informal solicitation process pursuant to Section XI.A.1.1.5 of Procurement Policy and Procedure No. 201-2-1 for services obtained through an agreement with a public or quasi-public entity and because of the unique educational nature of the project and benefits to the City and the public and the lack of a reasonable possibility of obtaining better prices commensurate with the time and effort expended.

SECTION 5. That the City Manager is authorized and directed to execute the 2026 Water Loss Control Agreement between the City of San Clemente and the Municipal Water District of Orange County.

SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
