ORDINANCE NO. 1813
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, APPROVING AMENDMENTS TO CHAPTER 15.04 OF THE SAN CLEMENTE MUNICIPAL CODE TITLE 15 - BUILDINGS AND CONSTRUCTION, RELATING TO BUILDING REGULATIONS AND CONSTRUCTION ENFORCEMENT, AND FINDING THE ORDINANCE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15378 WHEREAS, the City has adopted Title 15 of the San Clemente Municipal Code regulating buildings and construction within the City, and WHEREAS, Chapter 15.04 of the San Clemente Municipal Code establishes local administrative procedures governing enforcement of the California Building Standards Code, including permit administration, inspections, unsafe structures, appeals, and code enforcement procedures; and WHEREAS, Chapter 15.04 was last comprehensively updated approximately in 2015, and since that time substantial changes have occurred in state law, California Building Standards Codes, municipal enforcement practices, housing legislation, and construction administration procedures; and WHEREAS, the amendments in this Ordinance are intended to modernize and clarify administrative procedures, improve consistency with current California Building Standards Codes and applicable state law, strengthen enforcement authority, and enhance the City’s ability to protect public health, safety, and welfare; and WHEREAS, the amendments in this Ordinance include revisions related to the authority and duties of the Building Official, emergency safety procedures, correction notices, appeals procedures, temporary sanitation requirements, site stability evaluations, and home owners association notification procedures.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE DOES ORDAIN AS FOLLOWS:
SECTION 1: Incorporation of Recitals. The City Council hereby finds that all of the facts in the Recitals are true and correct and are incorporated and adopted as findings of the City Council as fully set forth in this Ordinance.
SECTION 2: CEQA Findings. Based on a review of the record as a whole, the City Council finds that adoption of this Ordinance is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15378, because the ordinance constitutes organizational and administrative activities of government that will not result in direct or indirect physical changes to the environment.
SECTION 3: Code Amendments. Chapter 15.04 of Title 15 of the San Clemente Municipal Code is hereby amended as set forth in Exhibit “A,” attached hereto and incorporated herein fully by this reference.
SECTION 4. Publication. The City Clerk shall certify to the adoption of this ordinance by the City Council and cause it, or a summary of it, to be published once within 15 days of adoption in a newspaper of general circulation printed and published within the City of San Clemente, and shall post a certified copy of this ordinance, including the vote for and against the same, in the Office of the City Clerk in accordance with California Government Code, Section 36933.
SECTION 5. Records. The documents and materials associated with this ordinance that constitute the record of proceedings on which the City Council’s findings and determinations are based are located at City Hall, 910 Calle Negocio, San Clemente, CA 92673.
SECTION 6. The City Clerk shall certify to the passage of this Ordinance and publish the same in the manner required by law, and this Ordinance shall take effect as provided by law.
SECTION 7. Severability. If any section, sentence, clause or phrase of this Ordinance or the application thereof to any entity, person or circumstance is held for any reason to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable. The City Council hereby declares that it would have adopted this Ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.
