RESOLUTION NO. 26-159
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, SUPPORTING SENATE BILL 329 (BLAKESPEAR) AND SENATE BILL 490 (UMBERG) AND AUTHORIZING THE MAYOR TO EXECUTE LETTERS REQUESTING THE GOVERNOR’S SIGNATURE WHEREAS, a recent State audit found deficiencies in the Department of Health Care Services’ investigation and oversight of alcohol and drug treatment facilities, including lengthy delays in completing complaint investigations and inadequate follow-up involving certain unlicensed facilities; and WHEREAS, Senate Bill 329 (Blakespear) would establish timelines for the California Department of Health Care Services to assign and complete investigations into complaints involving licensed alcohol and drug treatment facilities and would require annual public reporting regarding those investigations, thereby improving accountability and transparency in State oversight; and WHEREAS, Senate Bill 490 (Umberg) would strengthen State enforcement of unlicensed sober living homes by establishing investigation timelines, requiring follow-up site visits, and allowing counties to partner with the Department of Health Care Services to respond more quickly to violations; and WHEREAS, delays and gaps in State oversight can make it more difficult for the City to address community concerns, maintain public safety, and support recovery and treatment programs within the community; and WHEREAS, Senate Bill 329 and Senate Bill 490 have passed the California Legislature and are currently before the Governor for consideration; and WHEREAS, the League of California Cities sponsored Senate Bill 329 and Senate Bill 490 and has requested that member cities submit letters urging the Governor to sign both bills into law.

NOW, THEREFORE, the City Council of the City of San Clemente does hereby resolve as follows:

SECTION 1. The City Council hereby supports Senate Bill 329 (Blakespear) and Senate Bill 490 (Umberg).

SECTION 2. The Mayor is authorized to execute letters requesting that the Governor sign Senate Bills 329 and 490, in substantially similar form to those provided as Attachments 3 and 5 to the City Council Agenda Report entitled, “Consideration of a Resolution in Support of Senate Bills 329 and 490 Regarding Oversight and Enforcement of Facilities Providing Alcohol and Drug Treatment and Sober Living Services”, dated September 15, 2026.

SECTION 3. City staff is authorized to transmit the executed letters to the Governor and other appropriate parties.

SECTION 4. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions.
