RESOLUTION NO. 26-153
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN CLEMENTE, CALIFORNIA, AWARDING A PROFESSIONAL CONSULTANT SERVICES AGREEMENT TO DUNCAN ENGINEERING FOR WATERFRONT STRUCTURAL INSPECTION AND DESIGN SERVICES FOR THE PIER IMPROVEMENTS PROJECT, CIP PROJECT NO. 17149, AUTHORIZING THE CITY MANAGER TO EXECUTE THE PROFESSIONAL SERVICES AGREEMENT IN AN AMOUNT NOT TO EXCEED $116,213 AND FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT UNDER CLASS 1 (EXISTING FACILITIES, 14 CCR 15301) OF THE STATE CEQA GUIDELINES WHEREAS, the City of San Clemente Municipal Pier was originally constructed in 1928. It has been subsequently reconstructed twice, with the innermost two-thirds of the pier closest to the shore supported by timber piling and the outermost one-third of the pier furthest from the shore supported by steel pipe piling; and WHEREAS, the City of San Clemente Municipal Pier has recently had portions of its structural elements damaged and found to be in need of repairs and replacement; and WHEREAS, the Municipal Pier must be inspected biennially as part of the City’s requirements set forth by the California Coastal Commission; and WHEREAS, the proposed Pier Improvements Project will address the required inspection for regulatory compliance and the preparation of plans and specifications for the repair of damaged sections of the pier; and WHEREAS, project implementation requires structural inspection and design services provided by a professional engineer with niche expertise; and WHEREAS, staff prepared a Request for Proposal for the waterfront structural inspection and design services needed for the project, and solicited proposals from six firms; and WHEREAS, proposals were received from three firms, Duncan Engineering, KPFF, and Moffatt & Nichol, and the fee proposals ranged from $116,213 to $392,800; and WHEREAS, following a review of written proposals and interviews conducted by City staff, it was determined that Duncan Engineering was the most qualified team, with extensive knowledge and relevant experience at a fair and reasonable price; and WHEREAS, the scope of work includes inspection, preparation of plans and specifications, permitting assistance, bidding support, and construction support services.
NOW, THEREFORE, the City Council of the City of San Clemente does hereby find, determine, and resolve as follows:
SECTION 1. That the above recitations are true and correct and incorporated fully herein.
SECTION 2. Based on a review of the record as a whole, the City Council finds and determines that the Pier Improvements project, CIP Project No. 17419, is categorically exempt from CEQA under Class 1 (Existing Facilities, 14 CCR 15301) of the State CEQA Guidelines because the project consists of the repair of the already existing Municipal Pier.
SECTION 3. That a Professional Consultant Services Agreement is hereby awarded to Duncan Engineering for the Waterfront Structural Inspection and Design for the Pier Improvements Project, CIP Project No. 17149.
SECTION 4. That the City Manager is hereby authorized and directed to execute a Professional Services Agreement with Duncan Engineering in an amount not to exceed $116,213, in a form substantially similar to that presented to the City Council on September 15, 2026, for the Waterfront Structural Inspection and Design for the Pier Improvements Project, CIP Project No. 17149.
SECTION 5. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
